Be it enacted by the Senate and House of Representa- 1 tives of the United States of America in Congress assembled, 2 SECTION 1. SHORT TITLE. 3 This Act may be cited as the ‘‘30 × 30 Termination 4 Act’’. 5 SEC. 2. DEFINITIONS. 6 In this Act: 7 (1) FEDERAL LAND.— 8 (A) IN GENERAL.—The term ‘‘Federal 9 land’’ means— 10 VerDate Sep 11 2014 02:39 May 29, 2021 Jkt 019200 PO 00000 Frm 00001 Fmt 6652 Sfmt 6201 E:\BILLS\S1673.IS S1673 ctelli on DSK11ZRN23PROD with BILLS 2 •S 1673 IS (i) National Forest System land; 1 (ii) public lands (as defined in section 2 103 of the Federal Land Policy and Man- 3 agement Act of 1976 (43 U.S.C. 1702)); 4 (iii) the outer Continental Shelf (as 5 defined in section 2 of the Outer Conti- 6 nental Shelf Lands Act (43 U.S.C. 1331)); 7 and 8 (iv) Federal land within the Exclusive 9 Economic Zone of the United States, as 10 established by Presidential Proclamation 11 5030, dated March 10, 1983 (16 U.S.C. 12 1453 note). 13 (B) INCLUSION.—The term ‘‘Federal 14 land’’ includes land described in clauses (i) 15 through (iv) of subparagraph (A) for which the 16 rights to the surface estate or subsurface estate 17 are owned by a non-Federal entity. 18 (2) MULTIPLE USE.—The term ‘‘multiple use’’ 19 has the meaning given the term in section 103 of the 20 Federal Land Policy and Management Act of 1976 21 (43 U.S.C. 1702). 22 (3) PRINCIPAL OR MAJOR USE.—The term 23 ‘‘principal or major use’’ includes domestic livestock 24 grazing, mineral exploration and production, rights- 25 VerDate Sep 11 2014 02:21 May 28, 2021 Jkt 019200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\S1673.IS S1673 ctelli on DSK11ZRN23PROD with BILLS 3 •S 1673 IS of-way, timber production, commercial fishing, rec- 1 reational fishing, hunting, camping, hiking, moun- 2 tain biking, horseback riding, whitewater rafting, 3 and off-highway vehicle use, and other outdoor 4 recreation. 5 SEC. 3. REVOCATION OF EXECUTIVE ORDER RELATING TO 6 CONSERVING OUR NATION’S LANDS AND 7 WATERS. 8 (a) IN GENERAL.—Section 216 of Executive Order 9 14008 (86 Fed. Reg. 7627; relating to tackling the climate 10 crisis at home and abroad (February 1, 2021)) shall have 11 no force or effect. 12 (b) LIMITATION ON FUNDS.—No Federal funds may 13 be used to implement, administer, enforce, or carry out 14 any report or program substantially similar to the report 15 or program required under section 216 of the Executive 16 Order described in subsection (a). 17 SEC. 4. NO NET LOSS OF NON-FEDERAL LAND. 18 No Federal funds may be used to acquire non-Fed- 19 eral land within a State or county in which 15 percent 20 or more of the land is managed by a Federal agency, un- 21 less the Federal agency proposing the acquisition disposes 22 of an equal amount of Federal land within the State or 23 county in which the non-Federal land is located to ensure 24 no net loss of non-Federal land and taxable acreage during 25 VerDate Sep 11 2014 02:21 May 28, 2021 Jkt 019200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6201 E:\BILLS\S1673.IS S1673 ctelli on DSK11ZRN23PROD with BILLS 4 •S 1673 IS the fiscal year in which the proposed acquisition occurs 1 and subsequent fiscal years as a result of the proposed 2 acquisition. 3 SEC. 5. NO NET LOSS OF MULTIPLE USE. 4 No Federal funds may be used to implement, admin- 5 ister, enforce, or carry out any action on Federal land that 6 results in a net loss of multiple use or any principal or 7 major use within a State, unless the action has been au- 8 thorized by an Act of Congress. 9 SEC. 6. STATE AND CONGRESSIONAL APPROVAL REQUIRED 10 PRIOR TO THE FEDERAL ACQUISITION OF 11 MORE THAN 160 ACRES OF NON-FEDERAL 12 LAND. 13 No Federal funds may be used by the head of a Fed- 14 eral agency to acquire more than 160 acres of non-Federal 15 land unless— 16 (1) the head of the Federal agency has received 17 from the State in which the non-Federal land is lo- 18 cated written notice that the State has enacted legis- 19 lation approving the proposed acquisition; and 20 (2) the proposed acquisition has been author- 21 ized by an Act of Congress. 22 SEC. 7.
