Be it enacted by the Senate and House of Representa- 1 tives of the United States of America in Congress assembled, 2 SECTION 1. CONFIRMATION REQUIREMENT. 1 Subtitle A of title II of division A of the CARES Act 2 is amended by adding at the end the following: 3 ‘‘SEC. 2119. CONFIRMATION OF EMPLOYMENT STATUS FOR 4 LONG-TERM UNEMPLOYED INDIVIDUALS. 5 ‘‘(a) IN GENERAL.—As a condition of each of the 6 agreements described in sections 2104 and 2107, a State 7 shall— 8 ‘‘(1) notify each long-term unemployed indi- 9 vidual in the State that the State unemployment 10 agency will seek confirmation of the individual’s cur- 11 rent employment status from the individual’s most 12 recent employer (except in cases in which such em- 13 ployer no longer exists); 14 ‘‘(2) request each employer described in para- 15 graph (1) to submit information to the State unem- 16 ployment agency with respect to each such individual 17 describing whether— 18 ‘‘(A) the individual’s position is not avail- 19 able at the time of the request; or 20 ‘‘(B) the individual’s position is available 21 but the individual has refused to return to 22 work; 23 ‘‘(3) in any case in which an employer submits 24 information to the State unemployment agency with 25 respect to an individual that describes a position 26 VerDate Sep 11 2014 04:41 Jun 15, 2021 Jkt 019200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\H3266.IH H3266 kjohnson on DSK79L0C42PROD with BILLS 3 •HR 3266 IH that remains unavailable as described in paragraph 1 (1), notify such individual, not later than the stand- 2 ard processing time for applications for regular un- 3 employment compensation in the State after receipt 4 of such information, that the individual’s unem- 5 ployed status has been confirmed; and 6 ‘‘(4) in any case in which an employer submits 7 information to the State unemployment agency with 8 respect to an individual that describes a refusal to 9 return to work as described in paragraph (2)(B), or 10 in any case in which an employer fails to submit in- 11 formation described in paragraph (2) not later than 12 the standard processing time for applications for 13 regular unemployment compensation in the State 14 after the date of the request, terminate the individ- 15 ual’s Federal Pandemic Unemployment Compensa- 16 tion under section 2104 or Pandemic Emergency 17 Unemployment Compensation under section 2107, 18 as applicable. 19 ‘‘(b) DEFINITION.—The term ‘long-term unemployed 20 individual’ means an individual who has received Federal 21 Pandemic Unemployment Compensation under section 22 2104 or Pandemic Emergency Unemployment Compensa- 23 VerDate Sep 11 2014 04:41 Jun 15, 2021 Jkt 019200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6201 E:\BILLS\H3266.IH H3266 kjohnson on DSK79L0C42PROD with BILLS 4 •HR 3266 IH tion under section 2107 for more than 30 weeks of unem- 1 ployment.’’. 2 Æ VerDate Sep 11 2014 04:41 Jun 15, 2021 Jkt 019200 PO 00000 Frm 00004 Fmt 6652 Sfmt 6301 E:\BILLS\H3266.IH H3266 kjohnson on DSK79L0C42PROD with BILLS
