Be it enacted by the Senate and House of Representa- 1 tives of the United States of America in Congress assembled, 2 SECTION 1. LIMITING THE SCOPE OF REGULATIONS OF THE DE- 1 PARTMENT OF HEALTH AND HUMAN SERV- 2 ICES TO CONTROL COMMUNICABLE DIS- 3 EASES. 4 Section 361(a) of the Public Health Service Act (42 5 U.S.C. 264(a)) is amended by striking ‘‘The Surgeon Gen- 6 eral,’’ and all that follows through ‘‘may be necessary.’’ 7 at the end and inserting the following: ‘‘To prevent the 8 introduction, transmission, or spread of communicable dis- 9 eases from foreign countries into the States or posses- 10 sions, or from one State or possession into any other State 11 or possession, the Secretary may make and enforce regula- 12 tions under this section— 13 ‘‘(1) for the measures authorized under sub- 14 sections (b) through (d); or 15 ‘‘(2) to provide for such inspection, fumigation, 16 disinfection, sanitation, pest extermination, or de- 17 struction of animals or articles found to be so in- 18 fected or contaminated as to be sources of dangerous 19 infection to human beings.’’. 20 Æ VerDate Sep 11 2014 05:20 May 27, 2021 Jkt 019200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6301 E:\BILLS\S1615.IS S1615 kjohnson on DSK79L0C42PROD with BILLS
