SHORT TITLE. 1 This Act may be cited as the ‘‘Arizona Experiment 2 Station Land Conveyance Act of 2021 2022’’. 3 SEC. 2. DEFINITIONS. 4 In this Act: 5 (1) EASEMENT.—The term ‘‘easement’’ means 6 an easement to access and use Forest Service Road 7 9201D from its junction with Forest Service Road 8 0618 (commonly known as ‘‘Beaver Creek’’). 9 (2) FEDERAL LAND.—The term ‘‘Federal land’’ 10 means the approximately 13.3 acres of National 11 Forest System land within the Coconino National 12 Forest in the State of Arizona, as generally depicted 13 on the map entitled ‘‘Act to Convey Certain NFS 14 Land and non-Federal Land in Arizona Winter 15 Quarters’’ and dated June 20, 2019. 16 (3) SECRETARY.—The term ‘‘Secretary’’ means 17 the Secretary of Agriculture. 18 (4) UNIVERSITY.—The term ‘‘University’’ 19 means the Arizona Board of Regents, acting on be- 20 half of the University of Arizona Experiment Sta- 21 tion. 22 SEC. 3. COCONINO NATIONAL FOREST LAND CONVEYANCE. 23 (a) CONVEYANCE AUTHORIZED.—Subject to this sec- 24 tion, if the University submits to the Secretary not later 25 than 180 days after the date of enactment of this Act a 26 VerDate Sep 11 2014 00:33 Sep 22, 2022 Jkt 029200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\S1631.RS S1631 kjohnson on DSK79L0C42PROD with BILLS 3 •S 1631 RS written request for the conveyance of the Federal land, 1 to acquire the Federal land for market value, as determined 2 by the appraisal conducted under subsection (d), the Sec- 3 retary shall, not later than 1 year after the date of enact- 4 ment of this Act, convey to the University all right, title, 5 and interest of the United States in and to that land, in- 6 cluding related infrastructure, improvements, and ease- 7 ments on that land. 8 (b) TERMS AND CONDITIONS.—The conveyance au- 9 thorized under subsection (a) shall be— 10 (1) subject to valid existing rights; 11 (2) notwithstanding any other provision of law; 12 and 13 (3) subject to any other terms and conditions 14 as considered appropriate by the Secretary. 15 (c) FOREST SERVICE ACCESS.—The Secretary shall 16 retain all other rights not included in the conveyance au- 17 thorized under subsection (a) to Forest Service Road 18 9201D from its junction with Forest Service Road 0618 19 (commonly known as ‘‘Beaver Creek’’), including the 20 maintenance of, and continued administrative access to, 21 that road. 22 (d) USE OF CONVEYED LAND.— 23 VerDate Sep 11 2014 00:33 Sep 22, 2022 Jkt 029200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6401 E:\BILLS\S1631.RS S1631 kjohnson on DSK79L0C42PROD with BILLS 4 •S 1631 RS (1) IN GENERAL.—As a condition of the con- 1 veyance under subsection (a), the Federal land shall 2 be— 3 (A) maintained by the University; and 4 (B) used for the purposes of land-grant 5 colleges and universities in accordance with— 6 (i) the Act of July 2, 1862 (commonly 7 known as the ‘‘First Morrill Act’’) (12 8 Stat. 503, chapter 130; 7 U.S.C. 301 et 9 seq.); 10 (ii) the Smith-Lever Act (7 U.S.C. 11 341 et seq.); and 12 (iii) the Hatch Act of 1887 (7 U.S.C. 13 361a et seq.). 14 (2) REVERSION.—If any portion of the Federal 15 land conveyed under subsection (a) is used in a 16 manner inconsistent with paragraph (1), the Federal 17 land shall, at the discretion of the Secretary, revert 18 to the United States. 19 (d) APPRAISAL.— 20 (1) IN GENERAL.—Not later than 90 days after 21 the date on which the University submits a written 22 request under subsection (a), the Secretary shall com- 23 plete an appraisal to determine the market value of 24 the Federal land. 25 VerDate Sep 11 2014 00:33 Sep 22, 2022 Jkt 029200 PO 00000 Frm 00004 Fmt 6652 Sfmt 6203 E:\BILLS\S1631.RS S1631 kjohnson on DSK79L0C42PROD with BILLS 5 •S 1631 RS (2) STANDARDS.—The appraisal under para- 1 graph (1) shall be conducted in accordance with— 2 (A) the Uniform Appraisal Standards for 3 Federal Land Acquisitions; and 4 (B) the Uniform Standards of Professional 5 Appraisal Practice. 6 VerDate Sep 11 2014 00:33 Sep 22, 2022 Jkt 029200 PO 00000 Frm 00005 Fmt 6652 Sfmt 6203 E:\BILLS\S1631.RS S1631 kjohnson on DSK79L0C42PROD with BILLS Calendar No. 498 117TH CONGRESS 2D SESSION S. 1631 [Report No. 117–155] A BILL To authorize the Secretary of Agriculture to convey certain National Forest System land in the State of Arizona to the Arizona Board of Regents, and for other purposes.
