Be it enacted by the Senate and House of Representa- 1 tives of the United States of America in Congress assembled, 2 SECTION 1. SHORT TITLE. 3 This Act may be cited as the ‘‘Self-Initiation Trade 4 Enforcement Act of 2021’’. 5 SEC. 2. TASK FORCE TO IDENTIFY POTENTIAL 6 COUNTERVAILABLE SUBSIDIES, DUMPING, 7 AND CIRCUMVENTION. 8 (a) IN GENERAL.—There is established, in the ad- 9 ministering authority, a task force to be responsible for— 10 VerDate Sep 11 2014 01:36 May 25, 2021 Jkt 019200 PO 00000 Frm 00001 Fmt 6652 Sfmt 6201 E:\BILLS\S1510.IS S1510 kjohnson on DSK79L0C42PROD with BILLS 2 •S 1510 IS (1) conducting research to— 1 (A) identify potential countervailable sub- 2 sidies and dumping that may be causing mate- 3 rial injury or threatening to cause material in- 4 jury to an industry in the United States; and 5 (B) identify potential circumvention of ex- 6 isting antidumping or countervailing duty or- 7 ders; and 8 (2) making recommendations, where appro- 9 priate, to the Under Secretary of Commerce for 10 International Trade with respect to initiating inves- 11 tigations under sections 702(a) and 732(a) of the 12 Tariff Act of 1930 (19 U.S.C. 1671a(a) and 13 1673a(a)) and circumvention inquires under section 14 781 of that Act (19 U.S.C. 1677j). 15 (b) DUTIES.—In carrying out the responsibilities of 16 the task force under subsection (a), the task force shall— 17 (1) monitor trade flows, government and indus- 18 try data, price fluctuations, domestic industry and 19 market conditions, and other relevant available in- 20 formation to identify potential countervailable sub- 21 sidies, dumping, or circumvention of existing anti- 22 dumping or countervailing duty orders; 23 (2) conduct background research on— 24 VerDate Sep 11 2014 01:36 May 25, 2021 Jkt 019200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\S1510.IS S1510 kjohnson on DSK79L0C42PROD with BILLS 3 •S 1510 IS (A) production capabilities and pricing 1 practices of foreign companies; 2 (B) foreign government subsidies; and 3 (C) other relevant information available to 4 the task force; 5 (3) consult with, or solicit information from, the 6 United States International Trade Commission, U.S. 7 Customs and Border Protection, and such other 8 Federal agencies as the task force considers appro- 9 priate; and 10 (4) prioritize cases that affect small and me- 11 dium-sized businesses in the United States. 12 (c) CONSULTATIONS.—In carrying out the respon- 13 sibilities of the task force under subsection (a), the task 14 force shall consult with industries in the United States 15 with respect to potential countervailable subsidies, dump- 16 ing, and circumvention. 17 (d) NONDISCLOSURE OF CERTAIN INFORMATION.— 18 The administering authority shall not disclose information 19 with regard to the activities of the task force under this 20 section unless and until a determination is made to initiate 21 an investigation under section 702(a) or 732(a) of the 22 Tariff Act of 1930 (19 U.S.C. 1671a(a) and 1673a(a)) 23 or a circumvention inquiry under section 781 of that Act 24 (19 U.S.C. 1677j), as the case may be. 25 VerDate Sep 11 2014 01:36 May 25, 2021 Jkt 019200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6201 E:\BILLS\S1510.IS S1510 kjohnson on DSK79L0C42PROD with BILLS 4 •S 1510 IS (e) DEFINITIONS.—In this section, the terms ‘‘ad- 1 ministering authority’’, ‘‘countervailable subsidy’’, ‘‘dump- 2 ing’’, ‘‘industry’’, and ‘‘material injury’’ have the mean- 3 ings given those terms in section 771 of the Tariff Act 4 of 1930 (19 U.S.C. 1677). 5 Æ VerDate Sep 11 2014 01:36 May 25, 2021 Jkt 019200 PO 00000 Frm 00004 Fmt 6652 Sfmt 6301 E:\BILLS\S1510.IS S1510 kjohnson on DSK79L0C42PROD with BILLS
