A BILL
To amend title XVIII of the Social Security Act to provide
for coverage of certain lymphedema compression treat-
ment items under the Medicare program.

SECTION 1. SHORT TITLE.

This Act may be cited as the ‘‘Lymphedema Treat-
2
ment Act’’.
3
SEC. 2. MEDICARE COVERAGE OF CERTAIN LYMPHEDEMA
4
COMPRESSION TREATMENT ITEMS.
5
(a) IN GENERAL.—Section 1861 of the Social Secu-
6
rity Act (42 U.S.C. 1395x) is amended—
7
(1) in subsection (s)(2)—
8
(A) in subparagraph (GG), by striking
9
‘‘and’’ after the semicolon at the end;
10
(B) in subparagraph (HH), by striking the
11
period at the end and inserting ‘‘; and’’; and
12
(C) by adding at the end the following new
13
subparagraph:

‘‘(II) lymphedema compression treatment items
15
(as defined in subsection (lll));’’; and
16
(2) by adding at the end the following new sub-
17
section:

‘‘Lymphedema Compression Treatment Items
19
‘‘(lll) The term ‘lymphedema compression treatment
20
items’ means—
21
‘‘(1) standard and custom fitted gradient com-
22
pression garments that are—
23
‘‘(A) furnished on or after January 1,
24
2023, to an individual with a diagnosis of

lymphedema for the treatment of such condi-
1
tion;
2
‘‘(B) primarily and customarily used in the
3
medical treatment of lymphedema, as deter-
4
mined by the Secretary; and
5
‘‘(C) prescribed by a physician (or a physi-
6
cian assistant, nurse practitioner, or a clinical
7
nurse specialist (as those terms are defined in
8
section 1861(aa)(5)) to the extent authorized
9
under State law); and
10
‘‘(2) other devices determined by the Secretary
11
to be effective in the prevention or treatment of
12
lymphedema.’’.

(b) EFFECTIVE DATE.—The amendments made by
14
subsection (a) shall apply to lymphedema compression
15
treatment items furnished on or after January 1, 2023.
