RULEMAKING TO INSTALL AUTOMATIC SHUTOFF 1 SYSTEMS AND ROLLAWAY PREVENTION 2 TECHNOLOGY IN MOTOR VEHICLES. 3 (a) DEFINITIONS.—In this section: 4 (1) KEY.—The term ‘‘key’’ has the meaning 5 given the term in section 571.114 of title 49, Code 6 of Federal Regulations (or successor regulations). 7 (2) MANUFACTURER.—The term ‘‘manufac- 8 turer’’ has the meaning given the term in section 9 30102(a) of title 49, United States Code. 10 (3) MOTOR VEHICLE.— 11 (A) IN GENERAL.—The term ‘‘motor vehi- 12 cle’’ has the meaning given the term in section 13 30102(a) of title 49, United States Code. 14 (B) EXCLUSIONS.—The term ‘‘motor vehi- 15 cle’’ does not include— 16 (i) a motorcycle or trailer (as those 17 terms are defined in section 571.3 of title 18 49, Code of Federal Regulations) (or suc- 19 cessor regulations); 20 (ii) any motor vehicle that is rated at 21 more than 10,000 pounds gross vehicular 22 weight; or 23 (iii) for purposes of subsection (b), a 24 battery electric vehicle. 25 VerDate Sep 11 2014 23:26 May 14, 2021 Jkt 019200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\S1268.IS S1268 pamtmann on DSKBC07HB2PROD with BILLS 3 •S 1268 IS (4) SECRETARY.—The term ‘‘Secretary’’ means 1 the Secretary of Transportation. 2 (b) AUTOMATIC SHUTOFF SYSTEMS FOR MOTOR VE- 3 HICLES.— 4 (1) FINAL RULE.— 5 (A) IN GENERAL.—Not later than 2 years 6 after the date of enactment of this Act, the Sec- 7 retary shall issue a final rule amending section 8 571.114 of title 49, Code of Federal Regula- 9 tions (relating to Federal Motor Vehicle Safety 10 Standard Number 114), to require manufactur- 11 ers to install in each motor vehicle equipped 12 with a keyless ignition device and an internal 13 combustion engine technology to automatically 14 shut off the motor vehicle after the motor vehi- 15 cle has idled for the period designated under 16 subparagraph (B). 17 (B) PERIOD DESCRIBED.— 18 (i) IN GENERAL.—The period referred 19 to in subparagraph (A) is the period des- 20 ignated by the Secretary as necessary to 21 prevent carbon monoxide poisoning. 22 (ii) DIFFERENT PERIODS.—The Sec- 23 retary may designate different periods 24 under clause (i) for different types of 25 VerDate Sep 11 2014 23:26 May 14, 2021 Jkt 019200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6201 E:\BILLS\S1268.IS S1268 pamtmann on DSKBC07HB2PROD with BILLS 4 •S 1268 IS motor vehicles, depending on the rate at 1 which the motor vehicle emits carbon mon- 2 oxide, if— 3 (I) the Secretary determines a 4 different period is necessary for a type 5 of motor vehicle for purposes of sec- 6 tion 30111 of title 49, United States 7 Code; and 8 (II) requiring a different period 9 for a type of motor vehicle is con- 10 sistent with the prevention of carbon 11 monoxide poisoning. 12 (2) DEADLINE.—The rule under paragraph (1) 13 shall become effective on September 1 of the first 14 calendar year beginning after the date on which the 15 Secretary issues that rule. 16 (c) PREVENTING MOTOR VEHICLES FROM ROLLING 17 AWAY.— 18 (1) REQUIREMENT.—Not later than 2 years 19 after the date of enactment of this Act, the Sec- 20 retary shall issue a final rule amending part 571 of 21 title 49, Code of Federal Regulations, to require 22 manufacturers to install technology to prevent move- 23 ment of motor vehicles equipped with keyless igni- 24 tion devices and automatic transmissions if— 25 VerDate Sep 11 2014 23:26 May 14, 2021 Jkt 019200 PO 00000 Frm 00004 Fmt 6652 Sfmt 6201 E:\BILLS\S1268.IS S1268 pamtmann on DSKBC07HB2PROD with BILLS 5 •S 1268 IS (A) the transmission of the motor vehicle 1 is not in the park setting; 2 (B) the motor vehicle does not exceed the 3 speed determined by the Secretary under para- 4 graph (2); 5 (C) the seat belt of the operator of the 6 motor vehicle is unbuckled; 7 (D) the service brake of the motor vehicle 8 is not engaged; and 9 (E) the door for the operator of the motor 10 vehicle is open. 11 (2) DETERMINATION.—The Secretary shall de- 12 termine the maximum speed at which a motor vehi- 13 cle may be safely locked in place under the condi- 14 tions described in subparagraphs (A), (C), (D), and 15 (E) of paragraph (1) to prevent vehicle rollaways. 16 (3) DEADLINE.—The rule under paragraph (1) 17 shall become effective on September 1 of the first 18 calendar year beginning after the date on which the 19 Secretary issues that rule. 20 Æ VerDate Sep 11 2014 23:26 May 14, 2021 Jkt 019200 PO 00000 Frm 00005 Fmt 6652 Sfmt 6301 E:\BILLS\S1268.IS S1268 pamtmann on DSKBC07HB2PROD with BILLS
