A BILL
To amend the Federal Trade Commission Act to include
requirements for declaring an unlawful act or practice,
and for other purposes.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

This Act may be cited as the ββStatement on Unfair-
4
ness Reinforcement and Emphasis Actββ or the ββSURE
5
Actββ.

SEC. 2. UNLAWFUL ACT OR PRACTICE.

Section 5(n) of the Federal Trade Commission Act
8
(15 U.S.C. 45(n)) is amended to read as follows:

ββ(1) SUBSTANTIAL INJURY REQUIRED.β

ββ(A) IN GENERAL.βThe Commission shall
2
have no authority under this section or section
3
18 to declare unlawful an act or practice on the
4
grounds that such act or practice is unfair un-
5
less the act or practice causes or is likely to
6
cause substantial injury to consumers which is
7
not reasonably avoidable by consumers them-
8
selves and not outweighed by countervailing
9
benefits to consumers or to competition.

SUMERS.βFor purposes of this subsection, an
12
act or practice does not cause and is not likely
13
to cause substantial injury to consumers if the
14
injury or harm resulting from such act or prac-
15
tice is trivial or merely speculative. An injury
16
may be sufficiently substantial if the injury
17
does a small harm to a large number of people.
18
An act or practice may be likely to cause a sub-
19
stantial injury if the act or practice raises a sig-
20
nificant risk of concrete harm.

ββ(C) CONSIDERATIONS REQUIRED.βIn de-
22
termining whether an act or practice causes or
23
is likely to cause substantial injury to con-

sumers under this subsection, the Commission

shall consider the following:

ββ(i) Whether the act or practice re-
3
sults in monetary harm.
4
ββ(ii) Whether the act or practice re-
5
sults in unwarranted health or safety risk.

ββ(iii) Whether the act or practice re-
7
sults only in emotional or other more sub-
8
jective harm.

ββ(2) NET EFFECTS OF INJURY REQUIRED.β

CONSIDERATIONS
REQUIRED.βAn

act or practice is not unfair unless the act or
12
practice is injurious in its net effects. In deter-
13
mining whether an act or practice is injurious
14
in its net effects, the Commission shall consider
15
the following:

ββ(i) The various costs for a remedy,
17
including the costs to the parties directly
18
before the Commission.
19
ββ(ii) The burdens on society in gen-
20
eral in the form of increased paperwork,
21
increased regulatory burdens on the flow of
22
information, reduced incentives to innova-
23
tion and capital formation, and other simi-
24
lar matters.

DECISIONS.βThe Com-

mission may not second-guess the wisdom of
2
particular consumer decisions, but may consider
3
whether the act or practice unreasonably cre-
4
ates or takes advantage of an obstacle to the
5
free exercise of consumer decisionmaking.

ββ(3) PUBLIC POLICY CONSIDERATIONS.βIn de-
7
termining whether an act or practice is unfair, the
8
Commission may consider established public policies
9
as evidence to be considered with all other evidence.
10
Such public policy considerations may not serve as
11
a primary basis for such determination.

ββ(4) ECONOMIC
ANALYSIS.βIn determining
13
whether an act or practice is unfair, the Commission
14
shall consider an economic analysis from the Bureau
15
of Economics of the Commission with respect to the
16
act or practice.ββ.
