and Mr. CRAWFORD) introduced the following bill; which was referred to
the Committee on Agriculture, and in addition to the Committee on Nat-
ural Resources, for a period to be subsequently determined by the Speak-
er, in each case for consideration of such provisions as fall within the ju-
risdiction of the committee concerned
A BILL
To conduct fire salvage on certain National Forest System
lands burned by wildfire, and for other purposes.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.
3
This Act may be cited as the ‘‘Forestry Improve-
4
ments to Restore the Environment Act of 2021’’ or the
5
‘‘FIRE Act of 2021’’.

SEC. 2. FOREST MANAGEMENT ACTIVITIES REQUIRED

AFTER WILDFIRE.
2
(a) SURVEY OF NATIONAL FOREST SYSTEM LANDS
3
IMPACTED BY WILDFIRE.—
4
(1) SURVEY REQUIRED.—To the maximum ex-
5
tent practicable, not later than 60 days after a wild-
6
fire is contained on National Forest System lands,
7
the Secretary of Agriculture, acting through the
8
Chief of the Forest Service, shall complete a survey
9
of the National Forest System lands that were im-
10
pacted by such wildfire.
11
(2) PRIORITY
OF
LAND
SURVEYED.—In car-
12
rying out a survey required under paragraph (1), the
13
Secretary of Agriculture shall give priority to Na-
14
tional Forest System lands in the following order:
15
(A) Lands for which there is, at the time
16
of such survey—
17
(i) timber under a contract pursuant
18
to section 14(a) of the National Forest
19
Management Act of 1976 (16 U.S.C.
20
472a); or
21
(ii) a stewardship contract under sec-
22
tion 604 of the Healthy Forests Restora-
23
tion Act of 2003 (16 U.S.C. 6591c).

(B) Lands for which, at the time of such
25
survey—

(i) a timber sale described in subpara-
1
graph (A)(i) or a stewardship contract de-
2
scribed in subparagraph (A)(ii) is planned;
3
and
4
(ii) with respect to such sale or con-
5
tract, an environmental decision document
6
has been completed pursuant to section
7
102 of the National Environmental Policy
8
Act of 1969 (42 U.S.C. 4332).

(b) CONVERSION OF TIMBER SALES.—
10
(1) TIMBER SALES TO SALVAGE SALES.—Not
11
later than 60 days after a wildfire is contained on
12
National Forest System lands, the Secretary of Agri-
13
culture shall, with respect to the timber sales appli-
14
cable to such lands that were impacted by such wild-
15
fire, convert such timber sales to salvage sales.

(2)
TREATMENT
OF
CONVERTED
TIMBER
17
SALES.—In the case of a project relating to the tim-
18
ber sales applicable to the National Forest System
19
lands described in paragraph (1), the conversion of
20
such timber sales to salvage sales under such para-
21
graph shall be deemed to meet the purpose and need
22
of such project for purposes of an environmental as-
23
sessment or an environmental impact statement pur-

suant to section 102 of the National Environmental

Policy Act of 1969 (42 U.S.C. 4332).

(c) SUPPLEMENTAL INFORMATION REPORTS.—The
3
Secretary of Agriculture shall give priority to completing
4
supplemental information reports that determine, with re-
5
spect to a pending project planned for National Forest
6
System lands prior to a wildfire, whether—
7
(1) timber salvage constitutes substantial
8
changes to the proposed action that are relevant to
9
environmental concerns; and
10
(2) wildfire constitutes significant new cir-
11
cumstances or information relevant to environmental
12
concerns.

SEC. 3. ROADSIDE SALVAGE CATEGORICAL EXCLUSION.
14
(a) CATEGORICAL EXCLUSION ESTABLISHED.—For-
15
est management activities described in subsection (b) are
16
a category of actions hereby designated as being categori-
17
cally excluded from the preparation of an environmental
18
assessment or an environmental impact statement pursu-
19
ant to section 102 of the National Environmental Policy
20
Act of 1969 (42 U.S.C. 4332).

(b) FOREST MANAGEMENT ACTIVITIES DESIGNATED
22
FOR CATEGORICAL EXCLUSION.—The category of forest
23
management activities designated under this section for
24
a categorical exclusion are forest management activities

carried out by the Secretary of Agriculture on National
1
Forest System lands where the primary purpose of such
2
activity is for roadside salvage activities that allow for the
3
removal of hazard trees that are within 200 feet of a road-
4
way center line.
5
(c) AVAILABILITY OF CATEGORICAL EXCLUSION.—
6
On and after the date of the enactment of this Act, the
7
Secretary of Agriculture may use the categorical exclusion
8
established under subsection (a) in accordance with this
9
section.
10
(d) ACREAGE LIMITATIONS.—The categorical exclu-
11
sion established under subsection (a) shall not be limited
12
in size or scope.

(e) EXCLUSION OF EXTRAORDINARY CIRCUMSTANCE
14
PROCEDURES.—The procedures relating to extraordinary
15
circumstances under section 220.6 of title 36, Code of
16
Federal Regulations (or a successor regulation), shall not
17
apply to the use of the categorical exclusion established
18
under subsection (b).
19
SEC. 4. JUDICIAL REVIEW.
20
(a) OBJECTION PERIOD.—For any action taken pur-
21
suant to the authorities in this Act, the objection time de-
22
scribed in section 219.56 of title 36, Code of Federal Reg-
23
ulations (or successor regulations), shall be 30 days.

(b) JUDICIAL REVIEW.—Except as provided in sub-
1
section (c), an activity carried out pursuant to this Act
2
shall be subject to judicial review in the same manner as
3
an authorized hazardous fuels reduction project is subject
4
to judicial review under section 106 of the Healthy Forests
5
Restoration Act of 2003 (16 U.S.C. 6516).
6
(c) PRELIMINARY INJUNCTION PROHIBITED.—Not-
7
withstanding any other provision of law, a court may not
8
order a preliminary injunction enjoining the Secretary of
9
Agriculture from proceeding with timber sales authorized
10
under this Act.
11
SEC. 5. RULE OF APPLICATION FOR NATIONAL FOREST
12
SYSTEM LANDS.
13
The authorities provided by this Act may not apply
14
with respect to any National Forest System lands—
15
(1) that are included in the National Wilderness
16
Preservation System;
17
(2) that are located within a national or State-
18
specific inventoried roadless area established by the
19
Secretary of Agriculture through regulation, un-
20
less—
21
(A) the forest management activity to be
22
carried out under such authority is consistent
23
with the forest plan applicable to the area; or

(B) the Secretary of Agriculture deter-

mines the forest management activity is permis-
2
sible under the applicable roadless rule gov-
3
erning such lands; or
4
(3) on which timber harvesting for any purpose
5
is prohibited by Federal statute.
