To amend the Tariff Act of 1930 to enhance the authority of U.S. Customs
and Border Protection to share information with respect to merchandise
suspected of violating intellectual property rights with rights holders
and other interested parties.

to the Committee on Finance
A BILL
To amend the Tariff Act of 1930 to enhance the authority
of U.S. Customs and Border Protection to share infor-
mation with respect to merchandise suspected of violating
intellectual property rights with rights holders and other
interested parties.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

TION WITH RESPECT TO MERCHANDISE SUS-

PECTED
OF
VIOLATING
INTELLECTUAL

PROPERTY RIGHTS.

Section 628A of the Tariff Act of 1930 (19 U.S.C.
5
1628a) is amended—
6
(1) in subsection (a), by striking paragraph (1)
7
and inserting the following:
8
‘‘(1) shall provide to the person information
9
that appears on the merchandise, including—
10
‘‘(A) its packaging, materials, and con-
11
tainers, including labels; and
12
‘‘(B) its packing materials and containers,
13
including labels; and’’; and
14
(2) in subsection (b)—
15
(A) in paragraph (3), by striking ‘‘; and’’
16
and inserting a semicolon;
17
(B) in paragraph (4), by striking the pe-
18
riod at the end and inserting ‘‘; and’’; and
19
(C) by adding at the end the following:
20
‘‘(5) any other party with an interest in the
21
merchandise, as determined appropriate by the Com-
22
missioner.’’.
