SHORT TITLE. 3 This Act may be cited as the ‘‘Fort San Gero´nimo 4 Preservation Act’’. 5 SEC. 2. DEFINITIONS. 6 In this Act: 7 (1) FORT SAN GERO´NIMO DEL BOQUERO´N.—The 8 term ‘‘Fort San Gero´nimo del Boquero´n’’ (also known 9 as ‘‘Fortı´n de San Gero´nimo del Boquero´n’’) means 10 the fort and grounds listed on the National Register 11 of Historic Places and located near Old San Juan, 12 Puerto Rico. 13 (2) SECRETARY.—The term ‘‘Secretary’’ means 14 the Secretary of the Interior. 15 SEC. 3. ESTABLISHMENT OF AFFILIATED AREA. 16 (a) IN GENERAL.—Fort San Gero´nimo del Boquero´n 17 in Puerto Rico is established as an affiliated area of the 18 National Park System. 19 (b) DESCRIPTION OF AFFILIATED AREA.—The affili- 20 ated area shall consist of the area generally depicted on the 21 map titled ‘‘Fort San Gero´nimo Proposed Affiliated Area’’, 22 numbered 910/176698, and dated July 2021. 23 (c) ADMINISTRATION.—The affiliated area shall be 24 managed in accordance with— 25 VerDate Sep 11 2014 01:03 Nov 17, 2022 Jkt 039200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6203 E:\BILLS\H2444.RH H2444 SSpencer on DSK126QN23PROD with BILLS 4 •HR 2444 RH (1) this Act; and 1 (2) any law generally applicable to units of the 2 National Park System. 3 (d) MANAGEMENT ENTITY.—The Institute of Puerto 4 Rican Culture shall be the management entity for the affili- 5 ated area. 6 (e) COOPERATIVE AGREEMENTS.—The Secretary may 7 provide technical assistance and enter into cooperative 8 agreements with the management entity for the purpose of 9 providing financial assistance for the marketing, marking, 10 interpretation, and preservation of the affiliated area. 11 (f) LIMITED ROLE OF THE SECRETARY.—Nothing in 12 this section authorizes the Secretary to acquire property at 13 the affiliated area or to assume managerial or financial re- 14 sponsibility for the operation, maintenance, or management 15 of the affiliated area. 16 (g) MANAGEMENT PLAN.— 17 (1) IN GENERAL.—The Secretary, in consultation 18 with the management entity, shall develop a manage- 19 ment plan for the affiliated area. 20 (2) TRANSMITTAL.—Not later than 3 years after 21 the date on which funds are first made available to 22 carry out this section, the Secretary shall submit the 23 management plan developed under paragraph (1) to 24 the Committee on Natural Resources of the House of 25 VerDate Sep 11 2014 01:03 Nov 17, 2022 Jkt 039200 PO 00000 Frm 00004 Fmt 6652 Sfmt 6203 E:\BILLS\H2444.RH H2444 SSpencer on DSK126QN23PROD with BILLS 5 •HR 2444 RH Representatives and the Committee on Energy and 1 Natural Resources of the Senate. 2 (h) PRIVATE PROPERTY PROTECTION.—Nothing in 3 this Act affects the land use rights of private property own- 4 ers adjacent to Fort San Gero´nimo del Boquero´n. 5 (i) NO BUFFER ZONES.— 6 (1) IN GENERAL.—Nothing in this Act shall be 7 construed to create buffer zones outside of Fort San 8 Gero´nimo del Boquero´n. 9 (2) ACTIVITY OR USE OUTSIDE FORT SAN 10 GERO´NIMO DEL BOQUERO´N.—The fact that an activ- 11 ity or use can be seen, heard, or detected from within 12 Fort San Gero´nimo del Boquero´n shall not preclude, 13 limit, control, regulate, or determine the conduct or 14 management of activities or uses outside of Fort San 15 Gero´nimo del Boquero´n. 16 VerDate Sep 11 2014 01:03 Nov 17, 2022 Jkt 039200 PO 00000 Frm 00005 Fmt 6652 Sfmt 6203 E:\BILLS\H2444.RH H2444 SSpencer on DSK126QN23PROD with BILLS Union Calendar No. 409 117TH CONGRESS 2D SESSION H.
