Be it enacted by the Senate and House of Representa- 1 tives of the United States of America in Congress assembled, 2 SECTION 1. SHORT TITLE. 3 This Act may be cited as the ‘‘Food Recovery Trans- 4 portation Act’’. 5 SEC. 2. FOOD WASTE RECOVERY TRANSPORTATION 6 GRANTS. 7 (a) AUTHORITY TO PROVIDE ASSISTANCE.— 8 (1) IN GENERAL.—From amounts made avail- 9 able to carry out this section, the Secretary of Agri- 10 VerDate Sep 11 2014 08:54 May 28, 2021 Jkt 019200 PO 00000 Frm 00001 Fmt 6652 Sfmt 6201 E:\BILLS\H2527.IH H2527 kjohnson on DSK79L0C42PROD with BILLS 2 •HR 2527 IH culture shall make grants to assist an eligible entity 1 with— 2 (A) purchasing, leasing, or otherwise ac- 3 quiring vehicles, including refrigerated vehicles, 4 or other equipment to carry out activities re- 5 lated to food recovery; 6 (B) reimbursing travel costs related to 7 food recovery at the per mile rate established by 8 the Commissioner of the Internal Revenue Serv- 9 ice; and 10 (C) the costs of preparing, storing, and 11 transporting donated food. 12 (2) LIMITATION.—An eligible entity may only 13 receive one grant under this section. 14 (b) APPLICATION.—To be eligible to receive a grant 15 under subsection (a), an eligible entity shall submit an ap- 16 plication to the Secretary of Agriculture, at such time, in 17 such manner, and containing such information as the Sec- 18 retary of Agriculture may require. 19 (c) ELIGIBLE ENTITY.—To be eligible for a grant 20 under subsection (a), a public food program service pro- 21 vider, a tribal organization, or a private nonprofit entity 22 (including a gleaner) shall— 23 (1) have experience in the area of— 24 VerDate Sep 11 2014 08:54 May 28, 2021 Jkt 019200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\H2527.IH H2527 kjohnson on DSK79L0C42PROD with BILLS 3 •HR 2527 IH (A) food recovery and distribution, particu- 1 larly concerning small and medium-sized farms; 2 (B) job training and business development 3 activities for food-related activities in low-in- 4 come communities; or 5 (C) efforts to reduce food insecurity in the 6 community, including food recovery and dis- 7 tribution, improving access to services, or co- 8 ordinating services and programs; and 9 (2) demonstrate competency to implement a 10 project, provide fiscal accountability, collect data, 11 and prepare reports and other necessary documenta- 12 tion. 13 (d) GLEANER DEFINED.—In this section, the term 14 ‘‘gleaner’’ has the meaning given the term in section 15 25(a)(2) of the Food and Nutrition Act of 2008 (7 U.S.C. 16 2034(a)(2)). 17 (e) AUTHORIZATION OF APPROPRIATIONS.—There is 18 authorized to carry out this section $10,000,000 for fiscal 19 year 2022. 20 Æ VerDate Sep 11 2014 08:54 May 28, 2021 Jkt 019200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6301 E:\BILLS\H2527.IH H2527 kjohnson on DSK79L0C42PROD with BILLS
