promote the safe and efficient management, operation,
and development of surface transportation systems, and
for other purposes.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

(a) SHORT TITLE.—This Act may be cited as the

‘‘Mobility Options, Resiliency, and Efficiency (MORE)
5
through TDM Act’’.

SEC. 1001. POLICY.

Section 134(a)(1) of title 23, United States Code, is
5
amended to read as follows:
6
‘‘(1) to encourage and promote the safe and ef-
7
ficient management, operation, and development of
8
surface transportation systems and support Trans-
9
portation demand management expectations and
10
goals that will serve the mobility needs of the people
11
and freight, foster economic growth and development
12
within and between States and urbanized areas, and
13
to take into consideration resiliency needs while

minimizing transportation related fuel consumption,

congestion, and air pollution through metropolitan
2
and Statewide transportation planning processes in
3
this chapter; and’’.

SEC. 1002. DEFINITIONS.
5
Section 101(a) of title 23, United States Code, is
6
amended by adding at the end the following:
7
‘‘(35) TRANSPORTATION
DEMAND
MANAGE-
8
MENT; TDM.—The terms ‘Transportation Demand
9
Management’ and ‘TDM’ mean the use of strategies
10
to inform and encourage travelers to maximize the
11
efficiency of a transportation system leading to im-
12
proved mobility, reduced congestion, and lower vehi-
13
cle emissions.

‘‘(36) TRANSPORTATION
DEMAND
MANAGE-
15
MENT STRATEGIES.—The term ‘Transportation De-
16
mand Management Strategies’ means the use of
17
planning, programs, policy, marketing, communica-
18
tions, incentives, pricing, data, and technology to
19
shift travel mode, routes used, departure times,
20
number of trips, and location and design of work
21
spaces or public attractions.’’.

SEC. 1003. REQUIREMENTS.

Section 134(c) of title 23, United States Code, is
24
amended—

(1) by striking paragraph (2) and inserting the

following:

‘‘(2) CONTENTS.—The plans and TIPs for each
3
metropolitan area shall provide for the development
4
and integrated management, including transpor-
5
tation demand management, and operation of trans-
6
portation systems and facilities (including accessible
7
pedestrian walkways, bicycle transportation facilities,
8
and intermodal facilities that support intercity trans-
9
portation and reduce the need of single-occupancy
10
vehicles and intercity bus facilities and commuter
11
vanpool providers) that will function as an inter-
12
modal transportation system for the metropolitan
13
planning area and as an integral part of an inter-
14
modal transportation system for the State and the
15
United States.’’; and
16
(2) by striking paragraph (3) and inserting the
17
following:
18
‘‘(3) PROCESS OF DEVELOPMENT.—The process
19
for developing the plans and TIPs shall provide for
20
consideration of all modes of transportation and
21
transportation demand management and shall be
22
continuing, cooperative, and comprehensive to the
23
degree appropriate, based on the complexity of the
24
transportation problems to be addressed.’’.

SEC. 1004. PLANNING.

Section 134(h) of title 23, United States Code, is
2
amended—

(1) in paragraph (1)—
4
(A) by striking ‘‘and’’ at the end of sub-
5
paragraph (I);
6
(B) by striking the period at the end of
7
subparagraph (J) and inserting a semicolon;
8
and
9
(C) by adding at the end, the following:
10
‘‘(K) summarize the issues, problems, bar-
11
riers and existing policies and programs of
12
transportation demand management;
13
‘‘(L) incentivize equitable and lower-cost
14
options for transportation systems, including
15
transportation demand management;
16
‘‘(M) identify strategies which provide
17
multimodal choices to single-occupancy vehicle
18
travel on the road; and
19
‘‘(N) mitigate congestion-related issues
20
and identify alternative transportation routes
21
and options during times of severe weather
22
storms and other natural disasters declared
23
local, State, and Federal state of emergencies.’’;

MANAGEMENT TARGETS.—Each Metropoli-
4
tan planning organization that is consid-
5
ered to be in nonattainment or mainte-
6
nance areas for at least one National Am-
7
bient Air Quality Standard as defined
8
under the Clean Air Act shall establish de-
9
mand management targets that address
10
the objectives, issues, and goals of trans-
11
portation demand management described
12
in subsection (b), where applicable, to use
13
in tracking progress toward attainment of
14
such critical outcomes for the region of the
15
metropolitan planning organization.’’.

SEC. 2001. REQUIREMENTS.

Section 135(a)(2) of title 23, United States Code, is

amended to read as follows:

plan and the transportation improvement program

developed for each State shall provide for transpor-
24

SEC. 2002. PLANNING.

Section 135(d)(1) of title 23, United States Code, is
13
amended—
14
(1) by striking ‘‘and’’ at the end of subpara-
15
graph (I);
16
(2) by striking the period at the end of sub-
17
paragraph (J) and inserting a semicolon; and
18
(3) by adding at the end the following:
19
‘‘(K) resolve issues, problems, and barriers
20
of transportation demand management;
21
‘‘(L) guide transportation investment deci-
22
sions including transportation demand manage-
23
ment policies, strategies, and performance
24
measures of the State;

‘‘(M) enhance private-sector and disadvan-

taged community involvement in providing
2
multimodal and multioccupancy transportation
3
programs and services that promote environ-
4
mental, safety, and equity goals and increase
5
economic activity; and
6
‘‘(N) improve operations and facilities with
7
mobility issues within the State, and a descrip-
8
tion of the strategies the State is employing to
9
address them, considering the objectives of
10
transportation demand management.’’.

SEC. 2003. RELATIONSHIP TO LONG-RANGE PLAN.
12
Section 135(f)(1) of title 23, United States Code, is
13
amended to read as follows:
14
‘‘(1) DEVELOPMENT.—Each State shall develop
15
a long-range Statewide transportation plan, with a
16
minimum 20-year forecast period for all areas of the
17
State, that provides for the development and imple-
18
mentation of the intermodal transportation system
19
and supports the objectives of transportation de-
20
mand management of the State.’’.

TITLE III—APPROPRIATIONS

AND GRANT PROGRAMS

SEC. 3001. AUTHORIZATIONS OF APPROPRIATIONS.
3
(a) AMENDMENT.—Chapter 1 of title 23, United
4
States Code, is amended by inserting after section 170 the
5
following:
6
‘‘§ 171. Transportation Demand Management imple-
7
mentation program
8
‘‘The Secretary of Transportation shall establish a
9
program to encourage and assist the development and
10
funding of Transportation Demand Management related
11
projects in accordance with this section and to further di-
12
rect Federal resources, as authorized in this section, to-
13
wards implementation of Transportation Demand Man-
14
agement objectives described in section 134(b).’’.
15
(b) IN GENERAL.—The following sums are author-
16
ized to be appropriated out of the Highway Trust Fund
17
(other than the Mass Transit Account): $250,000,000 for
18
each of fiscal years 2022 through 2026, to carry out sec-
19
tion 171 of title 23, United States Code.
20
(c) DIVISION OF FUNDS AMONG STATES.—The Sec-
21
retary shall distribute the funds authorized in subsection
22
(b) to the 50 States and the District of Columbia in ac-
23
cordance with the formula described in subsection (d).

(d) CALCULATION OF STATE AMOUNTS.—For each
1
of fiscal years 2022 through 2026, funds shall be distrib-
2
uted to each State and the District of Columbia in a for-
3
mula that mirrors the allocation/apportionment percent-
4
age each State or the District of Columbia receives under
5
section 104(c) of title 23, United States Code.
6
(e) USE OF FUNDS.—
7
(1) IN GENERAL.—States shall distribute funds
8
authorized under the TDM Implementation Program
9
in the form of competitive grants to eligible entities
10
to support the implementation of projects and pro-
11
grams identified within a State adopted Transpor-
12
tation Demand Management plan to support the
13
movement of people and result in reduced conges-
14
tion, environmental benefits, improved equity within
15
transportation systems, and support economic activ-
16
ity.
17
(2) ELIGIBLE PROJECTS.—Funds apportioned
18
to the State under this section for the TDM Imple-
19
mentation program may be obligated to carry out
20
one or more of the following:
21
(A) Technologies designed to inform and
22
promote the use of non-single occupancy vehi-
23
cles.

(B) Technologies designed to inform and
1
promote alternative trip mode options that im-
2
prove and assist the movement of all people.
3
(C) Marketing and promotional efforts to
4
promote mode choice and reduce the environ-
5
mental impacts of commuter movement.
6
(D) Real-time traffic and multimodal
7
transportation information systems that aim to
8
influence travel mode decisions and behavior.
9
(E) Work zone management and informa-
10
tion systems that aim to shift travel modes dur-
11
ing construction.
12
(F) Support the development of plans that
13
enhance disaster preparedness and mitigate
14
congestion along major travel routes during
15
times of emergency, natural disasters, and con-
16
struction that impacts existing road capacity.
17
(G) Any other multimodal surface trans-
18
portation project to improve the equitable flow
19
of all people and goods within the existing na-
20
tional highway infrastructure network.
21
(3) ELIGIBLE ENTITIES.—States are authorized
22
to award competitive grant funds, as identified in
23
this section, to the following organizations or enti-
24
ties:

tions’’ or ‘‘(TMOs)’’ mean associations, organizations, or
15
cooperatives that provide transportation services and edu-
16
cation to businesses, property owners, residents, and em-
17
ployees in a defined geographic area, combining their ef-
18
forts to expand transportation options and reduce pro-
19
gram costs. TMAs and TMOs are not-for-profit collabora-
20
tions of private and public sector entities working together
21
