was referred to the Committee on Oversight and Reform, and in addition
to the Committee on Energy and Commerce, for a period to be subse-
quently determined by the Speaker, in each case for consideration of such
provisions as fall within the jurisdiction of the committee concerned

To prohibit the use of Federal funds to implement any
COVID–19 vaccine passport system, and for other purposes.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

This Act may be cited as the ‘‘No Taxpayer Funding
4
for Vaccine Passports Act of 2021’’.

SEC. 2. PROHIBITING THE USE OF FEDERAL FUNDS TO IM-

PLEMENT ANY COVID–19 VACCINE PASSPORT

SYSTEM.

(a) IN GENERAL.—Notwithstanding any other provi-
4
sion of law, no funds appropriated under any Act may be
5
used for purposes of implementing, enforcing, or assisting
6
in the establishment of a COVID–19 vaccine passport sys-
7
tem (as defined in subsection (c)).

(b) STATE AND LOCAL USE OF COVID–19 VACCINE
9
PASSPORT SYSTEMS.—Notwithstanding any other provi-
10
sion of law, in the case of a State or a unit of local govern-
11
ment that implements, enforces, or assists in the establish-
12
ment of a COVID–19 vaccine passport system, no funds
13
appropriated under the Coronavirus Preparedness and Re-
14
sponse Supplemental Appropriations Act, 2020 (Public
15
Law 116–123), the Families First Coronavirus Response
16
Act (Public Law 116–127), the CARES Act (Public Law
17
116–136), the Paycheck Protection Program and Health
18
Care Enhancement Act (Public Law 116–139), division M
19
or N of the Consolidated Appropriations Act, 2021 (Public
20
Law 116–260), or the American Rescue Plan Act of 2021
21
(Public Law 117–2) may be made available to such State
22
or unit of local government.

(c) DEFINITIONS.—In this Act:

(1) COVID–19 VACCINE PASSPORT SYSTEM.—

means a system that requires proof (whether phys-

ical, electronic, or by any other means) of the vac-

cination status of an individual with respect to

COVID–19 as a condition of performing any action.

(2) STATE.—The term ‘‘State’’ means each of
5
the several States, the District of Columbia, and
6
each territory of the United States.
