Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,
2
SECTION 1. INTERIM HAZARDOUS WASTE PERMITS.

Section 3005(e) of the Solid Waste Disposal Act (42
4
U.S.C. 6925(e)) is amended—
5
(1) in paragraph (1)(A)—
6
(A) in clause (i), by striking ‘‘or’’ at the
7
end;
8
(B) in clause (ii), by inserting ‘‘or’’ after
9
‘‘this section,’’;
10
(C) by adding at the end the following:
11
‘‘(iii) is a critical energy resource facility,’’;
12
and
13
(2) by adding at the end the following:

‘‘(4) DEFINITIONS.—For the purposes of this sub-
15
section:
16
‘‘(A) CRITICAL ENERGY RESOURCE.—The term
17
‘critical energy resource’ means, as determined by the
18
Secretary of Energy, any energy resource—
19
‘‘(i) that is essential to the energy sector
20
and energy systems of the United States; and
21
‘‘(ii) the supply chain of which is vulner-
22
able to disruption.

‘‘(B) CRITICAL ENERGY RESOURCE FACILITY.—

The term ‘critical energy resource facility’ means a
