SHORT TITLE. 1 This Act may be cited as the ‘‘Debt Bondage Repair 2 Act’’. 3 SEC. 2. ADVERSE INFORMATION IN CASES OF TRAF- 4 FICKING. 5 (a) IN GENERAL.—The Fair Credit Reporting Act 6 (15 U.S.C. 1681 et seq.) is amended by inserting after 7 section 605B the following: 8 ‘‘§ 605C Adverse information in cases of trafficking 9 ‘‘(a) IN GENERAL.—A consumer reporting agency 10 may not furnish a consumer report containing any adverse 11 item of information about a consumer that resulted from 12 a severe form of trafficking in persons or sex trafficking 13 if the consumer has provided trafficking documentation to 14 the consumer reporting agency. 15 ‘‘(b) RULEMAKING.— 16 ‘‘(1) IN GENERAL.—The Director shall, not 17 later than 180 days after the date of the enactment 18 of this section, issue a rule to implement subsection 19 (a). 20 ‘‘(2) CONTENTS.—The rule issued pursuant to 21 paragraph (1) shall establish a method by which 22 consumers shall submit trafficking documentation to 23 consumer reporting agencies. 24 ‘‘(c) DEFINITIONS.— 25 VerDate Sep 11 2014 01:46 Jun 17, 2021 Jkt 019200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\H2332.RFS H2332 pbinns on DSKJLVW7X2PROD with BILLS 3 HR 2332 RFS ‘‘(1) TRAFFICKING DOCUMENTATION.—The 1 term trafficking documentation means— 2 ‘‘(A) documentation of either— 3 ‘‘(i) a determination by a Federal or 4 State government entity that a consumer is 5 a victim of trafficking; or 6 ‘‘(ii) a determination by a court of 7 competent jurisdiction that a consumer is 8 a victim of trafficking; and 9 ‘‘(B) documentation that identifies items 10 of adverse information that should not be fur- 11 nished by a consumer reporting agency because 12 the items resulted from the severe form of traf- 13 ficking in persons or sex trafficking of which 14 such consumer is a victim. 15 ‘‘(2) VICTIM OF TRAFFICKING.—For the pur- 16 poses of this section, the term ‘‘victim of traf- 17 ficking’’ means a person who is a victim of a severe 18 form of trafficking in persons or sex trafficking, as 19 such terms are defined in section 103 of the Traf- 20 ficking Victims Protection Act of 2000.’’. 21 (b) TABLE OF CONTENTS AMENDMENT.—The table 22 of contents of the Fair Credit Reporting Act is amended 23 by inserting after the item relating to section 605B the 24 following new item: 25 ‘‘605C. Adverse information in cases of trafficking.’’. VerDate Sep 11 2014 01:46 Jun 17, 2021 Jkt 019200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6211 E:\BILLS\H2332.RFS H2332 pbinns on DSKJLVW7X2PROD with BILLS 4 HR 2332 RFS (c) EFFECTIVE DATE.—The amendments made by 1 this section shall apply on the date that is 30 days after 2 the date on which the Director of the Bureau of Consumer 3 Financial Protection issues a rule pursuant to section 4 605C(b) of the Fair Credit Reporting Act. 5 (d) DETERMINATION OF BUDGETARY EFFECTS.— 6 The budgetary effects of this Act, for the purpose of com- 7 plying with the Statutory Pay-As-You-Go Act of 2010, 8 shall be determined by reference to the latest statement 9 titled ‘‘Budgetary Effects of PAYGO Legislation’’ for this 10 Act, submitted for printing in the Congressional Record 11 by the Chairman of the House Budget Committee, pro- 12 vided that such statement has been submitted prior to the 13 vote on passage. 14 Passed the House of Representatives June 15, 2021.
