To amend title XIX of the Social Security Act to provide coverage and
payment under title XIX of the Social Security Act for services furnished
to individuals who are patients in institutions for mental diseases during
the COVID–19 emergency period and 180-days thereafter, and for other
purposes.

bill; which was referred to the Committee on Energy and Commerce
A BILL
To amend title XIX of the Social Security Act to provide
coverage and payment under title XIX of the Social
Security Act for services furnished to individuals who
are patients in institutions for mental diseases during
the COVID–19 emergency period and 180-days there-
after, and for other purposes.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

This Act may be cited as the ‘‘Meeting IMD Needs
4
with Direction Act’’ or the ‘‘MIND Act’’.

THEREAFTER.

Section 1905(a) of the Social Security Act (42 U.S.C.
7
1396d(a)) is amended—
8
(1) in paragraph (1), by inserting ‘‘, provided,
9
however, that this exclusion for services in an insti-
10
tution for mental diseases does not apply to services
11
furnished to any individual during the period begin-
12
ning on the first day of the emergency period de-
13
scribed in section 1135(g)(1)(B) and ending on the
14
last day of the 180-day period succeeding such
15
emergency)’’ after ‘‘diseases’’;
16
(2) in paragraph (30)(B), by inserting ‘‘pro-
17
vided, however, that this subparagraph (B) does not
18
apply to services furnished to any such individual
19
during the period beginning on the first day of the
20
emergency period described in section 1135(g)(1)(B)
21
and ending on the last day of the 180-day period
22
succeeding
such
emergency’’
after
‘‘section

(3) by adding at the end of the flush left matter

diseases furnished to any individual during the pe-

riod beginning on the first day of the emergency pe-

riod described in section 1135(g)(1)(B) and ending

on the last day of the 180-day period succeeding

such emergency.’’.
