Mr. JOHNSON (for himself, Mrs. BLACKBURN, Mr. BRAUN, Mr. CASSIDY, Mr.
COTTON, Ms. ERNST, Mr. LANKFORD, and Mr. MCCONNELL) introduced
the following bill; which was read twice and referred to the Committee
on the Judiciary
A BILL
To amend the Controlled Substances Act to list fentanyl-
related substances as schedule I controlled substances.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

This Act may be cited as the ββStopping Overdoses
4
of Fentanyl Analogues Actββ.
5
SEC. 2. FENTANYL-RELATED SUBSTANCES.

(a) AMENDMENTS.βSection 202(c) of the Controlled
7
Substances Act (21 U.S.C. 812(c)) is amendedβ

(1) by adding at the end of subsection (b) of

Schedule I the following:

ββ(23) Isobutyryl fentanyl.

ββ(24) Para-Methoxybutyrylfentanyl.
4
ββ(25) Valeryl fentanyl.
5
ββ(26) Cyclopentyl fentanyl.

ββ(27) Para-Chloroisobutyryl fentanyl.ββ; and

(2) by adding at the end of Schedule I the fol-
8
lowing:

ββ(e)(1) Unless specifically exempted or unless listed
10
in another schedule, any material, compound, mixture, or
11
preparation which contains any quantity of fentanyl-re-
12
lated substances, or which contains their salts, isomers,
13
and salts of isomers whenever the existence of such salts,
14
isomers, and salts of isomers is possible within the specific
15
chemical designation.

ββ(2) In paragraph (1), the term βfentanyl-related sub-
17
stancesβ includes the following:
18
ββ(A) Any substance that is structurally related
19
to fentanyl by one or more of the following modifica-
20
tions:

ββ(i) By replacement of the phenyl portion
22
of the phenethyl group by any monocycle,
23
whether or not further substituted in or on the
24
monocycle.

group with alkyl, alkenyl, alkoxy, hydroxy, halo,

haloalkyl, amino or nitro groups.

ether, hydroxy, halo, haloalkyl, amino or nitro

groups.

with any aromatic monocycle whether or not

further substituted in or on the aromatic mono-

cycle.

ββ(v) By replacement of the N-propionyl

group by another acyl group.

ββ(B) 4β²-Methyl acetyl fentanyl.

ββ(C) Crotonyl fentanyl.
15
ββ(D) 2β²-Fluoro ortho-fluorofentanyl.

ββ(E) Ortho-Methyl acetylfentanyl.

ββ(F) Thiofuranyl fentanyl.
18
ββ(G) Ortho-Fluorobutyryl fentanyl.
19
ββ(H) Ortho-Fluoroacryl fentanyl.
20
ββ(I) Beta-Methyl fentanyl.
21
ββ(J) Phenyl fentanyl.
22
ββ(K) Para-Methylfentanyl.
23
ββ(L) Betaβ²-Phenyl fentanyl.
24
ββ(M) Benzodioxole fentanyl.ββ.
