A BILL
To amend the Federal Assets Sale and Transfer Act of
2016 to ensure that federally recognized Indian Tribes
are consulted before the sale or transfer of certain Fed-
eral civilian real properties, and for other purposes.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

This Act may be cited as the ‘‘Assuring Regular Con-
4
sultation To Have Indigenous Voices Effectively Solicited
5
Act’’.

SEC. 2. IMPACT ON FEDERALLY RECOGNIZED INDIAN

TRIBES.

(a) IN GENERAL.—The Federal Assets Sale and
3
Transfer Act of 2016 (40 U.S.C. 1303 note; Public Law
4
114–287) is amended by adding at the end the following:
5
‘‘SEC. 26. REQUIREMENTS BEFORE SALE OR TRANSFER.
6
‘‘(a) CONSULTATION.—Before the sale or transfer of
7
a Federal civilian real property under this Act (other than
8
section 24 or 25), if the proposed sale or transfer would
9
affect access to Federal agency services by a federally rec-
10
ognized Indian Tribe, the relevant Federal agency shall
11
consult with all Tribal governments that may be so af-
12
fected.

‘‘(b) FINDING OF REDUCTION OR ELIMINATION OF
14
ACCESS.—A Federal civilian real property may not be sold
15
or transferred under this Act (other than section 24 or
16
25) if the proposed sale or transfer would substantially
17
reduce or eliminate access to Federal agency services by
18
a federally recognized Indian Tribe.’’.
19
(b) CLERICAL AMENDMENT.—The table of contents
20
in section 1(b) of the Federal Assets Sale and Transfer
21
Act (Public Law 114–287; 130 Stat. 1463) is amended
22
by adding at the end the following:

‘‘Sec. 26. Requirements before sale or transfer.’’.
