with the Secretary of State, to formulate a strategy for entering into
agreements with foreign countries to develop and commercialize new
drugs to address pandemics, and for other purposes.

A BILL
To direct the Secretary of Health and Human Services,
in consultation with the Secretary of State, to formulate
a strategy for entering into agreements with foreign
countries to develop and commercialize new drugs to
address pandemics, and for other purposes.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

This Act may be cited as the ‘‘Saving Us from Pan-
4
demic Era Resistance by Building a Unified Global Strat-
5
egy Act of 2021’’ or the ‘‘SUPER BUGS Act of 2021’’.

SEC. 2. INTERNATIONAL STRATEGY FOR DEVELOPMENT OF

NEW DRUGS TO ADDRESS PANDEMICS.

(a) STRATEGY.—
3
(1) IN GENERAL.—Not later than 12 months
4
after the date of enactment of this Act, the Sec-
5
retary of Health and Human Services, in consulta-
6
tion with the Secretary of State, shall—
7
(A) formulate a strategy for entering into
8
agreements with foreign countries to help to de-
9
velop and commercialize (including through
10
contracts with the private sector) new drugs to
11
address
pandemics,
including
antimicrobial
12
drugs; and
13
(B) submit such strategy to the Congress.
14
(2) CONTENTS.—The strategy under paragraph
15
(1) shall—
16
(A) provide for the harmonization of agree-
17
ments and contracts described in paragraph
18
(1)(A);
19
(B) allow such countries to emphasize na-
20
tional or regional issues of importance; and
21
(C) provide for collaboration among such
22
countries, so as to allocate joint or individual
23
responsibility across such countries for the de-
24
velopment and commercialization of particular
25
drugs.

(b) AGREEMENTS WITH FOREIGN COUNTRIES.—The

Secretary of Health and Human Services, in consultation
2
with the Secretary of State, shall seek to enter into agree-
3
ments with foreign countries to implement the strategy
4
under subsection (a).
5
(c) DEFINITION.—In this section, the term ‘‘anti-
6
microbial drug’’ means—
7
(1) an antibiotic drug, as defined in section
8
201(jj) of the Federal Food, Drug, and Cosmetic
9
Act (21 U.S.C. 321(jj)); or
10
(2) a biological product, as defined in section
11
351(i) of the Public Health Service Act (42 U.S.C.
12
262(i)), that exhibits antimicrobial activity.
