AN ACT
To authorize the Secretary of the Interior to conduct a
study to assess the suitability and feasibility of desig-
nating certain land as the Ka’ena Point National Herit-
age Area, and for other purposes.
Be it enacted by the Senate and House of Representa-

SECTION 1. SHORT TITLE.

This Act may be cited as the ‘‘Ka‘ena Point National
2
Heritage Area Act’’.
3
SEC. 2. DEFINITIONS.

In this Act:
5
(1) HERITAGE
AREA.—The term ‘‘Heritage
6
Area’’ means the Ka‘ena Point National Heritage
7
Area.
8
(2) SECRETARY.—The term ‘‘Secretary’’ means
9
the Secretary of the Interior.
10
(3) STATE.—The term ‘‘State’’ means the State
11
of Hawai‘i.
12
(4) STUDY
AREA.—The term ‘‘study area’’
13
means Honolulu County on the island of O‘ahu.
14
SEC. 3. STUDY.
15
(a) IN GENERAL.—The Secretary, in consultation
16
with State and local historic preservation officers, State
17
and local historical societies, State and local tourism of-
18
fices, and other appropriate organizations and govern-
19
mental agencies, shall conduct a study to assess the suit-
20
ability and feasibility of designating the study area as a
21
National Heritage Area, to be known as the ‘‘Ka‘ena Point
22
National Heritage Area’’.

(b) REQUIREMENTS.—The study shall include anal-
24
ysis, documentation, and determinations on whether the
25
study area—

(1) has an assemblage of natural, historic, and
1
cultural resources that—
2
(A) represents distinctive aspects of the
3
heritage of the United States;
4
(B) is worthy of recognition, conservation,
5
interpretation, and continuing use; and
6
(C) would be best managed—
7
(i) through partnerships among public
8
and private entities; and
9
(ii) by linking diverse and sometimes
10
noncontiguous resources and active com-
11
munities;
12
(2) reflects traditions, customs, beliefs, and
13
folklife that are a valuable part of the story of the
14
United States;
15
(3) provides outstanding opportunities—
16
(A) to conserve natural, historic, cultural,
17
or scenic features; and
18
(B) for recreation and education;
19
(4) contains resources that—
20
(A) are important to any identified themes
21
of the study area; and
22
(B) retain a degree of integrity capable of
23
supporting interpretation;

(5) includes residents, business interests, non-
1
profit organizations, and State and local govern-
2
ments that—
3
(A) are involved in the planning of the
4
Heritage Area;
5
(B) have developed a conceptual financial
6
plan that outlines the roles of all participants in
7
the Heritage Area, including the Federal Gov-
8
ernment; and
9
(C) have demonstrated support for the des-
10
ignation of the Heritage Area;
11
(6) has a potential management entity to work
12
in partnership with the individuals and entities de-
13
scribed in paragraph (5) to develop the Heritage
14
Area while encouraging State and local economic ac-
15
tivity; and
16
(7) has a conceptual boundary map that is sup-
17
ported by the public.

SEC. 4. REPORT.

Not later than 3 years after the date on which funds
20
are first made available to carry out this Act, the Sec-
21
retary shall submit to the Committee on Natural Re-
22
sources of the House of Representatives and the Com-
23
mittee on Energy and Natural Resources of the Senate
24
a report that describes—

(1) the findings of the study under section 3;

and
2
(2) any conclusions and recommendations of the

Secretary.
