To amend title 10, United States Code, to eliminate the
enrollment fee requirement for TRICARE Select for
members of the Armed Forces who retired before Janu-
ary 1, 2018.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

This Act may be cited as the ‘‘TRICARE Select Res-
4
toration Act’’.

SEC. 2. ELIMINATION OF ENROLLMENT FEE REQUIREMENT

FOR TRICARE SELECT FOR CERTAIN RE-
2
TIRED MEMBERS OF THE ARMED FORCES.

(a) IN GENERAL.—Subsection (e) of section 1075 of
4
title 10, United States Code, is amended to read as fol-
5
lows:

‘‘(e) EXCEPTIONS
TO
CERTAIN
COST-SHARING
7
AMOUNTS FOR CERTAIN RETIRED BENEFICIARIES.—(1)
8
Notwithstanding subsection (d)—
9
‘‘(A) the annual enrollment fee for TRICARE
10
Select for beneficiaries who are former members of
11
the uniformed services who retired before January 1,
12
2018, shall be $0; and
13
‘‘(B) subject to paragraph (2), the annual en-
14
rollment fee for TRICARE Select for beneficiaries
15
described in subsection (c)(2)(B) in the retired cat-
16
egory who are not described in subparagraph (A)
17
shall be $150 for an individual and $300 for a fam-
18
ily.

‘‘(2) The modified enrollment fee established under
20
paragraph (1)(B) for beneficiaries described in subsection
21
(c)(2)(B) in the retired category shall not apply with re-
22
spect to the following beneficiaries:
23
‘‘(A) Retired members and the family members
24
of such members covered by paragraph (1) of section
25
1086(c) of this title by reason of being retired under

chapter 61 of this title or being a dependent of such

a member.

‘‘(B) Survivors covered by paragraph (2) of
3
such section 1086(c).’’.

(b) EFFECTIVE DATE.—The amendment made by
5
subsection (a) shall apply to annual enrollment fees under
6
TRICARE Select under section 1075 of title 10, United
7
States Code, for coverage under TRICARE Select after
8
December 31, 2021.
