AN ACT
To establish limitations regarding Confucius Institutes, and
for other purposes.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

This Act may be cited as the ‘‘Concerns Over Nations
2
Funding University Campus Institutes in the United
3
States Act’’ or the ‘‘CONFUCIUS Act’’.

SEC. 2. RESTRICTIONS ON CONFUCIUS INSTITUTES.

(a) DEFINITION.—In this section, the term ‘‘Confu-
6
cius Institute’’ means a cultural institute directly or indi-
7
rectly funded by the Government of the People’s Republic
8
of China.

(b) RESTRICTIONS ON CONFUCIUS INSTITUTES.—An
10
institution of higher education or other postsecondary edu-
11
cational institution (referred to in this section as an ‘‘insti-
12
tution’’) shall not be eligible to receive Federal funds from
13
the Department of Education (except funds under title IV
14
of the Higher Education Act of 1965 (20 U.S.C. 1070
15
et seq.) or other Department of Education funds that are
16
provided directly to students) unless the institution en-
17
sures that any contract or agreement between the institu-
18
tion and a Confucius Institute includes clear provisions
19
that—
20
(1) protect academic freedom at the institution;
21
(2) prohibit the application of any foreign law
22
on any campus of the institution; and
23
(3) grant full managerial authority of the Con-
24
fucius Institute to the institution, including full con-
25
trol over what is being taught, the activities carried

out, the research grants that are made, and who is

employed at the Confucius Institute.
