Be it enacted by the Senate and House of Representa-
1
tives of the United States of America in Congress assembled,
2
SECTION 1. SHORT TITLE.
3
This Act may be cited as the ‘‘Transparency in Energy
4
Production Act of 2021’’.
5
SEC. 2. DISCLOSURE REQUIREMENTS.
6
(a) REPORT REQUIRED FOR AN ENTITY SEEKING A
7
LEASE.—The Secretary concerned shall require any entity
8
seeking a lease to develop covered operations on public land
9
or Indian land to submit to the Secretary concerned a re-
10
port, at the time of submission of a bid to develop covered
11
operations. Such report shall—
12
(1) make the disclosures described in the Sus-
13
tainable Accounting Standard for the Extractives and
14
Minerals Processing Sector and the Renewable Re-
15
sources and Alternative Energy Sector in effect on the
16
date the report is filed (that is produced by the Sus-
17
tainability Accounting Standards Board) for the cov-
18
ered operations developed by the entity and in effect
19
at the date of such bid; and
20
(2) disaggregate the information in paragraph
21
(1) by State and by type of covered operation.

(b) REPORT REQUIRED FOR AN ENTITY HOLDING A
23
LEASE.—The Secretary concerned shall require any entity
24
holding a lease to develop covered operations on public land

or Indian land to submit to the Secretary concerned a re-
1
port annually. Such report shall—
2
(1) make the disclosures described in the Sus-
3
tainable Accounting Standard for the Extractives and
4
Minerals Processing Sector and the Renewable Re-
5
sources and Alternative Energy Sector in effect on the
6
date the report is filed (that is produced by the Sus-
7
tainability Accounting Standards Board); and
8
(2) disaggregate the information in paragraph
9
(1) by State and by type of covered operation.

(c) FAILURE TO COMPLY.—If the Secretary concerned
11
determines that an entity did not meet the requirements
12
of subsection (a), the Secretary concerned—
13
(1) may not issue to such entity a lease for a
14
covered operation; and
15
(2) may suspend a lease for a covered operation
16
held by such entity.

SEC. 3. ONLINE PUBLICATION OF DISCLOSURE.
18
The Secretary concerned shall make the information
19
reported under section 2 available to the public on an inter-
20
net website in a machine readable format.
21
SEC. 4. REPORT TO CONGRESS.
22
Not later than 2 years after the date of the enactment
23
of this Act and every 2 years thereafter, the Secretary con-
24
cerned shall submit a report to Congress that includes—

(1) with respect to covered operations, the an-
1
nual and 2-year totals of greenhouse gas emissions,
2
air quality, water management, biodiversity impacts,
3
production, and number of sites according to the
4
metrics described in the Sustainable Accounting
5
Standard for Oil and Gas Exploration and Produc-
6
tion in effect on the date the report is filed (that is
7
produced by the Sustainability Accounting Standards
8
Board) for covered operations on public land or In-
9
dian land; and
10
(2) the changes in the information in paragraph
11
(1);
12
(3) the projected future changes for 5, 10, and 25
13
years;
14
(4) for renewable energy operations, an estimate
15
of the greenhouse gas emissions that would result from
16
production of the same amount of energy using fossil
17
fuels and water management, including water use,
18
biodiversity impacts, production, number of sites, and
19
acres including associated transmission lines;
20
(5) the emission produced during the construc-
21
tion of solar panels and wind turbines that would be
22
used for renewable energy operations;
23
(6) a determination as to whether the materials
24
or labor for the construction of solar panels and wind

turbines used for renewable energy operations would
1
be sourced from the Xinjiang Autonomous Region in
2
China;
3
(7) the environmental impacts of the decommis-
4
sioning and disposal of renewable energy products
5
and electronic waste, including batteries, solar panels,
6
and products that have exceeded their life cycle;
7
(8) with respect to lands on which covered oper-
8
ations occur, the annual and 2-year totals of green-
9
house gas emissions, air quality, water management,
10
and biodiversity impacts of catastrophic wildfires, the
11
number of acres identified as being at high or very
12
high risk of wildfire, and the number of acres in need
13
of treatment or fuels reduction activities; and
14
(9) an assessment of the environmental and
15
human rights impacts in the production of renewable
16
energy products for the lifecycle of such products, in-
17
cluding such impacts from source materials for and
18
the disposal of such products.

SEC. 5. DEFINITIONS.

In this Act—
21
(1) the term ‘‘covered operation’’ means—
22
(A) any renewable energy operations;
23
(B) any fossil fuel operation; and

(C) any operation using any right-of-way
1
or special use permit that would cross public
2
lands, Indian lands, or national forests that
3
would facilitate fossil fuel development;
4
(2) the term ‘‘fossil fuel’’ means oil, natural gas,
5
natural gas liquids, coal, and any derivative of these
6
that is used for fuel;
7
(3) the term ‘‘Indian land’’ has the meaning
8
given such term in section 2601(2) of the Energy Pol-
9
icy Act of 1992 (25 U.S.C. 3501(2));
10
(4) the term ‘‘public land’’ means any land, in-
11
terest in land, or submerged land owned by the
12
United States;
13
(5) the term ‘‘renewable energy’’ means a project
14
carried out on public land or Indian land that uses
15
wind, solar, geothermal, wave, current, tidal, or ocean
16
thermal energy to generate electricity; and
17
(6) the term ‘‘Secretary concerned’’ means—
18
(A) the Secretary of the Interior, with re-
19
spect to public lands and Indian lands; and
20
(B) the Secretary of Agriculture, with re-
21
spect to National Forest System land.

SEC. 6. EFFECTIVE DATE.
23
This Act shall take effect 180 days after the date of
24
enactment of this Act.
