Mr. MORAN (for himself and Mr. BLUMENTHAL) introduced the following bill;
which was read twice and referred to the Committee on Commerce,
Science, and Transportation
A BILL
To reauthorize the United States Anti-Doping Agency, and
for other purposes.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.
3
This Act may be cited as the ββUnited States Anti-
4
Doping Agency Reauthorization Act of 2021ββ.
5
SEC. 2. FINDINGS.
6
Congress makes the following findings:
7
(1) The United States Anti-Doping Agencyβ
8
(A) is the independent national anti-doping
9
organization of the United States; and

(B) manages the anti-doping program, re-
1
sults management processes, drug reference re-
2
sources, and athlete education for all United
3
States Olympic Committee-recognized national
4
governing bodies and the athletes and events of
5
such national governing bodies.
6
(2) The United States Anti-Doping Agency con-
7
tributes to the advancement of clean sport through
8
scientific research, anti-doping education, and out-
9
reach programs, and the mission of the United
10
States Anti-Doping Agency is to preserve the integ-
11
rity of competition and protect the rights of athletes.
12
(3) Participation in youth sports has the poten-
13
tial to equip young athletes with important skills
14
and values necessary for success in life, and it is es-
15
sential that the culture of youth sports emphasizes
16
such skills and values.
17
(4) The TrueSport program of the United
18
States Anti-Doping Agency partners with youth
19
sport organizations across the United States to pro-
20
mote sportsmanship, character building, and healthy
21
performance through the use of targeted educational
22
materials designed to promote a positive youth sport
23
experience.

(5) In modifying the authority of the United
1
States Anti-Doping Agency to include the promotion
2
of the positive values of youth sport, Congress sends
3
a strong signal that the goals of youth sport should
4
include instilling in young athletes the values of in-
5
tegrity, respect, teamwork, courage, and responsi-
6
bility.
7
(6) Due to the unique leadership position of the
8
United States in the global community, adequate
9
funding of the anti-doping and clean sport programs
10
of the United States Anti-Doping Agency is impera-
11
tive to the preparation for the 2028 Summer Olym-
12
pic Games, which will be held in Los Angeles, Cali-
13
fornia.
14
(7) Increased appropriations for fiscal years
15
2022 through 2030 would enable the United States
16
Anti-Doping Agency to directly affect the integrity
17
and well-being of sport, both domestically and inter-
18
nationally.

SEC. 3. MODIFICATIONS OF AUTHORITY.

Section 701 of the Office of National Drug Control
21
Policy Reauthorization Act of 2006 (21 U.S.C. 2001) is
22
amendedβ

(1) in subsection (b)β

(A) by amending paragraph (1) to read as

follows:

ββ(1)(A) serve as the independent anti-doping
3
organization for the amateur athletic competitions
4
recognized by the United States Olympic and
5
Paralympic Committee;
6
ββ(B) be responsible for certifying in advance
7
any testing conducted by international organizations
8
under the World Anti-Doping Code for international
9
amateur athletes and athletic competitions occurring
10
within the jurisdiction of the United States; and
11
ββ(C) be recognized worldwide as the inde-
12
pendent national anti-doping organization for the
13
United States;ββ;
14
(B) in paragraph (4), by striking the pe-
15
riod at the end and inserting ββ; andββ; and
16
(C) by adding at the end the following:
17
ββ(5) promote a positive youth sport experience
18
by using a portion of the funding of the United
19
States Anti-Doping Agency to provide educational
20
materials on sportsmanship, character building, and
21
healthy performance for the athletes, parents, and
22
coaches who participate in youth sports.ββ; and

(2) by adding at the end the following:

CEEDINGS.βAny action taken by the United States Anti-

Doping Agency to enforce a policy, procedure, or require-
3
ment of the United States Anti-Doping Agency against a
4
person with respect to a violation of Federal law, including
5
an investigation, a disciplinary action, a sanction, or any
6
other administrative action, shall be carried out in a man-
7
ner that provides due process protection to the person.ββ.

SEC. 4. AUTHORIZATION OF APPROPRIATIONS.

Section 703 of the Office of National Drug Control
10
Policy Reauthorization Act of 2006 (21 U.S.C. 2003) is
11
amended to read as follows:

SEC. 5. INFORMATION SHARING.

Except as otherwise prohibited by law and except in
2
cases in which the integrity of a criminal investigation
3
would be affected, pursuant to the obligation of the United
4
States under Article 7 of the United Nations Educational,
5
Scientific, and Cultural Organization International Con-
6
vention Against Doping in Sport done at Paris October
7
19, 2005, and ratified by the United States in 2008, the
8
Attorney General, the Secretary of Homeland Security,
9
and the Commissioner of Food and Drugs shall provide
10
to the United States Anti-Doping Agency any relevant in-
11
formation relating to the prevention of the use of perform-
12
ance-enhancing drugs or the prohibition of performance-
13
enhancing methods.
