To amend chapter 44 of title 18, United States Code, to protect the rights
of citizens under the Second Amendment to the Constitution of the
United States.

A BILL
To amend chapter 44 of title 18, United States Code, to
protect the rights of citizens under the Second Amend-
ment to the Constitution of the United States.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.
3
This Act may be cited as the ‘‘Gun Owner Privacy
4
Act’’.
5
SEC. 2. PROTECTION OF SECOND AMENDMENT RIGHTS.
6
Section 922(t) of title 18, United States Code, is
7
amended by adding at the end the following:

‘‘(7)(A) None of the funds appropriated pursu-
1
ant to any provision of law may be used for—
2
‘‘(i) any system to implement this sub-
3
section that does not require and result in the
4
immediate destruction of all information, in any
5
form whatsoever, submitted by or on behalf of
6
any person who has been determined not to be
7
prohibited from owning a firearm; or
8
‘‘(ii) the implementation or collection of
9
any tax or fee by any officer, agent, or em-
10
ployee of the United States, or by any State or
11
local officer or agent acting on behalf of the
12
United States, in connection with the imple-
13
mentation of this subsection.

‘‘(B) Any person aggrieved by a violation of this
15
paragraph may bring an action in the district court
16
of the United States for the district in which the
17
person resides.
18
‘‘(C) Any person who is successful with respect
19
to an action brought under subparagraph (B) shall
20
receive damages, punitive damages, and such other
21
remedies as the court may determine to be appro-
22
priate, including a reasonable attorney’s fee.’’.
