A BILL
To impose an annual deadline of June 1 for small refineries
to submit petitions for exemptions from the renewable
fuel requirements under section 211(o) of the Clean Air
Act (42 U.S.C. 7545(o)) based on disproportionate eco-
nomic hardship.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

This Act may be cited as the ‘‘Renewable Fuel Stand-
4
ard Integrity Act of 2021’’.

SEC. 2. ANNUAL DEADLINE FOR PETITIONS BY SMALL RE-

FINERIES FOR EXEMPTIONS FROM RENEW-
2
ABLE FUEL REQUIREMENTS.

(a) DEADLINE.—Notwithstanding any other provi-
4
sion of law, petitions under section 211(o)(9) of the Clean
5
Air Act (42 U.S.C. 7545(o)(9)) for an exemption from the
6
requirements of section 211(o)(2) of such Act (42 U.S.C.
7
7545(o)(2)) shall be submitted to the Administrator of the
8
Environmental Protection Agency by June 1 of the year
9
preceding the year when such requirements would other-
10
wise be in effect.

(b) EFFECT OF FAILURE TO MEET DEADLINE.—If
12
a petition described in subsection (a) is not submitted by
13
the deadline specified in such subsection, the petition shall
14
be ineligible for consideration or approval.

SEC. 3. INFORMATION IN PETITION SUBJECT TO PUBLIC
16
DISCLOSURE.

(a) IN GENERAL.—The information described in sub-
18
section (b) in any submission to the Administrator of the
19
Environmental Protection Agency by any person, includ-
20
ing a small refinery, with respect to a petition under sec-
21
tion 211(o)(9)(B) of the Clean Air Act (42 U.S.C.
22
7545(o)(9)(B))—
23
(1) shall not be deemed to be a trade secret or
24
confidential information; and

(2) shall be subject to public disclosure, not-
1
withstanding section 552(b) of title 5, United States
2
Code.

(b) DESCRIBED INFORMATION.—The information de-
4
scribed in this subsection is—
5
(1) the name of the small refinery requesting
6
an extension of an exemption;
7
(2) the number of gallons of renewable fuel that
8
will not be contained in fuel pursuant to section
9
211(o)(2) of the Clean Air Act (42 U.S.C.
10
7545(o)(2)) as a result of the extension if the exten-
11
sion is granted; and
12
(3) the compliance year for which the extension
13
is requested.

(c) APPLICABILITY.—Subsection (a) applies only with
15
respect to information submitted with respect to a petition
16
under section 211(o)(9)(B) of the Clean Air Act (42
17
U.S.C. 7545(o)(9)(B)) for calendar year 2023 or subse-
18
quent calendar years.
