Be it enacted by the Senate and House of Representa- 1 tives of the United States of America in Congress assembled, 2 SECTION 1. APPLICATION OF NEPA AND NHPA TO COVERED 3 COMMUNICATIONS EQUIPMENT OR SERV- 4 ICES. 5 (a) NEPA EXEMPTION.—A covered project shall not 6 be subject to the requirements of section 102(2)(C) of the 7 National Environmental Policy Act of 1969 (42 U.S.C. 8 4332(2)(C)). 9 (b) NATIONAL HISTORIC PRESERVATION ACT EX- 10 EMPTION.—A covered project shall not be considered an 11 undertaking under section 300320 of title 54, United 12 States Code. 13 (c) COVERED PROJECT DEFINED.—In this section, 14 the term ‘‘covered project’’ means a project to perma- 15 nently remove covered communications equipment or serv- 16 ices (as defined in section 9 of the Secure and Trusted 17 Communications Networks Act of 2019 (47 U.S.C. 1608)) 18 and to replace such covered communications equipment or 19 services with communications equipment or services that 20 are not covered communications equipment or services (as 21 so defined). 22 Æ VerDate Sep 11 2014 17:07 Mar 12, 2021 Jkt 019200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6301 E:\BILLS\H1053.IH H1053
