Be it enacted by the Senate and House of Representa- 1 tives of the United States of America in Congress assembled, 2 SECTION 1. SHORT TITLE. 3 This Act may be cited as the ‘‘COVID–19 Supply 4 Chain Resiliency Act of 2021’’. 5 SEC. 2. OFFICE OF COVID–19 SUPPLY CHAIN RESILIENCY. 6 (a) ESTABLISHMENT OF OFFICE.—There is estab- 7 lished in the Executive Office of the President the Office 8 of COVID–19 Supply Chain Resiliency (in this section re- 9 ferred to as ‘‘the Office’’). 10 VerDate Sep 11 2014 01:04 Mar 09, 2021 Jkt 019200 PO 00000 Frm 00001 Fmt 6652 Sfmt 6201 E:\BILLS\H1024.IH H1024 pamtmann on DSKBC07HB2PROD with BILLS 2 •HR 1024 IH (b) DIRECTOR.— 1 (1) IN GENERAL.—There shall be at the head 2 of the Office a Director who shall be appointed by 3 the President. 4 (2) APPOINTMENT OF FIRST DIRECTOR.—Not 5 later than 30 days after the date of the enactment 6 of this Act, the President shall appoint an individual 7 to serve as the Director. 8 (3) VACANCY.—A vacancy in the position of Di- 9 rector shall be filled not later than 60 days after the 10 date on which the vacancy occurs and shall be filled 11 in the same manner in which the original appoint- 12 ment was made. 13 (c) DEPUTY DIRECTORS.— 14 (1) TYPES OF DEPUTY DIRECTORS.—To assist 15 the Director in carrying out the functions of this 16 Act, the Director shall appoint Deputy Directors as 17 follows: 18 (A) The Deputy Director for the Medical 19 Supply Chain. 20 (B) The Deputy Director for the Food 21 Supply Chain. 22 (C) The Deputy Director for the Industrial 23 Supply Chain. 24 VerDate Sep 11 2014 01:04 Mar 09, 2021 Jkt 019200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\H1024.IH H1024 pamtmann on DSKBC07HB2PROD with BILLS 3 •HR 1024 IH (D) The Deputy Director for Interagency 1 Coordination. 2 (2) ADDITIONAL DEPUTY DIRECTORS.—The Di- 3 rector may appoint additional Deputy Directors as 4 the Director determines necessary. 5 (d) FUNCTIONS.—The functions of the Office are 6 to— 7 (1) identify supply chain issues related the 8 COVID–19 pandemic; 9 (2) not later than 60 days after the establish- 10 ment of the Office, establish a national strategy to 11 address such supply chain issues, in consultation 12 with— 13 (A) the heads of other agencies of the Fed- 14 eral Government, including— 15 (i) the Secretary of Agriculture; 16 (ii) the Secretary of Commerce; 17 (iii) the Secretary of Defense; 18 (iv) the Secretary of Health and 19 Human Services; 20 (v) the Secretary of Homeland Secu- 21 rity; 22 (vi) the Secretary of Labor; 23 (vii) the Secretary of Transportation; 24 (viii) the Secretary of the Treasury; 25 VerDate Sep 11 2014 01:04 Mar 09, 2021 Jkt 019200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6201 E:\BILLS\H1024.IH H1024 pamtmann on DSKBC07HB2PROD with BILLS 4 •HR 1024 IH (ix) the Administrator of the Environ- 1 mental Protection Agency; 2 (x) the Administrator of the Federal 3 Emergency Management Agency; 4 (xi) the Federal Trade Commission; 5 (xii) the Administrator of the Small 6 Business Administration; and 7 (xiii) the United States Trade Rep- 8 resentative; 9 (B) persons or private sector entities that 10 transport products by air, water, rail, and road; 11 (C) manufacturers of durable consumer 12 products; 13 (D) producers of agricultural products; 14 (E) manufacturers and distributors of 15 drugs, devices, and other medical products and 16 supplies; and 17 (F) manufacturers, producers, and dis- 18 tributors of other supplies critical to national 19 security and the COVID–19 pandemic; 20 (3) serve as a central point of contact for Fed- 21 eral and non-Federal entities seeking technical as- 22 sistance with respect to supply chain issues related 23 to the COVID–19 pandemic; 24 VerDate Sep 11 2014 01:04 Mar 09, 2021 Jkt 019200 PO 00000 Frm 00004 Fmt 6652 Sfmt 6201 E:\BILLS\H1024.IH H1024 pamtmann on DSKBC07HB2PROD with BILLS 5 •HR 1024 IH (4) provide technical assistance to Federal and 1 non-Federal entities seeking technical assistance 2 with respect to supply chain issues related to the 3 COVID–19 pandemic; and 4 (5) develop legislative recommendations to 5 strengthen critical supply chains for pandemics, in- 6 cluding the COVID–19 pandemic. 7 (e) REPORT TO CONGRESS.—Not later than 180 days 8 after the date of the enactment of this Act, the Director 9 shall submit a report to Congress on— 10 (1) any supply chain issues identified under 11 paragraph (1) of subsection (d); 12 (2) the national strategy established under such 13 subsection; and 14 (3) any legislative recommendation developed 15 under such subsection. 16 (f) TERMINATION.—The Office established under this 17 section shall terminate on the date that is 18 months after 18 the date on which the Public Health Emergency declared 19 by the Secretary of Health and Human Services under 20 section 319 of the Public Health Services Act (42 U.S.C. 21 247) as a result of COVID–19 pandemic, and any renewal 22 thereof, terminates. 23 Æ VerDate Sep 11 2014 01:04 Mar 09, 2021 Jkt 019200 PO 00000 Frm 00005 Fmt 6652 Sfmt 6301 E:\BILLS\H1024.IH H1024 pamtmann on DSKBC07HB2PROD with BILLS
