Be it enacted by the Senate and House of Representa- 1 tives of the United States of America in Congress assembled, 2 SECTION 1. SHORT TITLE. 3 This Act may be cited as the ‘‘No Taxpayer Funding 4 for the Chinese Communist Party Act of 2021’’. 5 SEC. 2. FINDINGS. 6 Congress finds the following: 7 VerDate Sep 11 2014 20:28 Mar 08, 2021 Jkt 019200 PO 00000 Frm 00001 Fmt 6652 Sfmt 6201 E:\BILLS\H992.IH H992 pamtmann on DSKBC07HB2PROD with BILLS 2 •HR 992 IH (1) United States taxpayer-funded research 1 should not be used to benefit the People’s Republic 2 of China, especially as China undertakes the largest 3 theft of intellectual property in history, as was stat- 4 ed by Secretary of Defense Mark Esper. 5 (2) According to the Committee on Homeland 6 Security and Governmental Affairs of the Senate, 7 there were more than 35,000 foreign nationals in- 8 cluding 10,000 from China conducting research in 9 the Department of Energy’s National Labs. 10 (3) According to the Department of Education 11 ‘‘one university received research funding from a 12 Chinese multinational conglomerate to develop new 13 algorithms and advanced biometric security tech- 14 niques for crowd surveillance capabilities,’’ while an- 15 other ‘‘had multiple contracts with the Central Com- 16 mittee of the Communist Party of China’’. 17 (4) The Committee on Homeland Security and 18 Governmental Affairs of the Senate found in a No- 19 vember 2019 report that ‘‘American taxpayer funded 20 research has contributed to China’s global rise over 21 the last 20 years’’. 22 (5) The Federal Bureau of Investigation has 23 found that China’s government has used some stu- 24 dents and professors in science, technology, engi- 25 VerDate Sep 11 2014 20:28 Mar 08, 2021 Jkt 019200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\H992.IH H992 pamtmann on DSKBC07HB2PROD with BILLS 3 •HR 992 IH neering, and math (STEM) fields as nontraditional 1 collectors of intellectual property, but has also noted 2 that ‘‘the vast majority of the 1.4 million inter- 3 national scholars on U.S. campuses pose no threat 4 to their host institutions, fellow classmates, or re- 5 search fields. On the contrary, these international 6 visitors represent valuable contributors to their cam- 7 puses’ achievements, providing financial benefits, di- 8 versity of ideas, sought expertise, and opportunities 9 for cross-cultural exchange’’. 10 SEC. 3. REPORT ON CHINA BENEFITTING FROM UNITED 11 STATES TAXPAYER-FUNDED RESEARCH. 12 (a) IN GENERAL.—Not later than one year after the 13 date of enactment of the Act, the Attorney General, in 14 consultation with the Secretary of the Treasury, the Sec- 15 retary of Commerce, the Secretary of State, and the Direc- 16 tor of National Intelligence, shall submit to the Committee 17 on the Judiciary of the House of Representatives and the 18 Committee on the Judiciary of the Senate a report on the 19 extent to which China has benefitted from United States 20 taxpayer-funded research. 21 (b) ELEMENTS.—The report under subsection (a) 22 shall include the following: 23 (1) The extent to which United States tax- 24 payer-funded research has benefitted China, includ- 25 VerDate Sep 11 2014 20:28 Mar 08, 2021 Jkt 019200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6201 E:\BILLS\H992.IH H992 pamtmann on DSKBC07HB2PROD with BILLS 4 •HR 992 IH ing a list of United States Government-funded enti- 1 ties, such as research institutions, laboratories, and 2 institutions of higher education, which have hired 3 Chinese nationals or allowed Chinese nationals to 4 conduct research, including an estimate in the num- 5 ber of nationals hired or involved in research 6 projects. 7 (2) A list of United States Government pro- 8 grams, grants, and other forms of research funding 9 in the fields of science, technology, engineering, and 10 math (STEM) fields that have directly or indirectly 11 cooperated or affiliated with research institutions in 12 China or Chinese Communist Party entities. 13 (3) The extent to which China’s funding of 14 United States taxpayer-funded research institutions 15 has benefitted China. 16 (4) How the Government of China and the Chi- 17 nese Communist Party have used United States tax- 18 payer-funded research, including as part of China’s 19 efforts to support ‘‘civil-military fusion’’ and human 20 rights abuses. 21 (c) DEFINITION.—In this Act, the term ‘‘United 22 States taypayer-funded research’’ means research— 23 (1) funded by a grant from the Federal Govern- 24 ment or a State government; or 25 VerDate Sep 11 2014 20:28 Mar 08, 2021 Jkt 019200 PO 00000 Frm 00004 Fmt 6652 Sfmt 6201 E:\BILLS\H992.IH H992 pamtmann on DSKBC07HB2PROD with BILLS 5 •HR 992 IH (2) conducted at an institution that receives 1 funding from the Federal Government or a State 2 government. 3 Æ VerDate Sep 11 2014 20:28 Mar 08, 2021 Jkt 019200 PO 00000 Frm 00005 Fmt 6652 Sfmt 6301 E:\BILLS\H992.IH H992 pamtmann on DSKBC07HB2PROD with BILLS
