A BILL
To limit the availability of COVID–19 vaccines for certain
individuals detained at United States Naval Station,
Guantanamo Bay, Cuba, and for other purposes.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

This Act may be cited as the ‘‘Vaccinate Americans,
4
Not Terrorists Act’’.

SEC. 2. LIMITATION ON COVID–19 VACCINE FOR CERTAIN

INDIVIDUALS DETAINED AT UNITED STATES

NAVAL STATION, GUANTANAMO BAY, CUBA.

(a) LIMITATION FOR INDIVIDUALS DETAINED.—No
4
Federal Government entity may provide a COVID–19 vac-
5
cine to an individual detained in the custody or under the
6
control of the Department of Defense pursuant to the law
7
of war or a proceeding under chapter 47A of title 10,
8
United States Code, at United States Naval Station,
9
Guantanamo Bay, Cuba, if—
10
(1) there is any outstanding request from a
11
State to the Federal Government for the COVID–19
12
vaccine;
13
(2) there is any outstanding request from a
14
State to the Federal Government for pandemic relief
15
relating to COVID–19; or
16
(3) any member of the Armed Forces (including
17
the reserve components) performing active service
18
who intends to receive the COVID–19 vaccine has
19
not yet received such vaccine.

(b) DEFINITIONS.—In this section:
21
(1) The term ‘‘COVID–19 vaccine’’ means any
22
vaccine approved or authorized by the Food and
23
Drug Administration for the corornavirus disease
24
2019 (COVID–19).

(2) The term ‘‘State’’ includes each of the sev-

eral States, the District of Columbia, each common-
2
wealth, territory, or possession of the United States,
3
and each federally recognized Indian Tribe.
