AUTHORIZATION TO ESTABLISH COMMEMORA- 1 TIVE WORK. 2 (a) IN GENERAL.—The National Medal of Honor 3 Museum Foundation may establish a commemorative work 4 on Federal land in the District of Columbia and its envi- 5 rons to honor the extraordinary acts of valor, selfless serv- 6 ice, and sacrifice displayed by Medal of Honor recipients. 7 (b) COMPLIANCE WITH STANDARDS FOR COMMEMO- 8 RATIVE WORKS.—The establishment of the commemora- 9 tive work under this section shall be in accordance with 10 chapter 89 of title 40, United States Code (commonly 11 known as the ‘‘Commemorative Works Act’’). 12 (c) PROHIBITION ON THE USE OF FEDERAL 13 FUNDS.— 14 (1) IN GENERAL.—Federal funds may not be 15 used to pay any expense of the establishment of the 16 commemorative work under this section. 17 (2) RESPONSIBILITY OF THE NATIONAL MEDAL 18 OF HONOR MUSEUM FOUNDATION.—The National 19 Medal of Honor Museum Foundation shall be solely 20 responsible for acceptance of contributions for, and 21 payment of the expenses of, the establishment of the 22 commemorative work under this section. 23 (d) DEPOSIT OF EXCESS FUNDS.— 24 (1) IN GENERAL.—If, on payment of all ex- 25 penses for the establishment of the commemorative 26 VerDate Sep 11 2014 01:45 Dec 17, 2021 Jkt 029200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\S172.RS S172 pbinns on DSKJLVW7X2PROD with BILLS 3 •S 172 RS work under this section (including the maintenance 1 and preservation amount required by section 2 8906(b)(1) of title 40, United States Code), there 3 remains a balance of funds received for the estab- 4 lishment of the commemorative work, the National 5 Medal of Honor Museum Foundation shall transmit 6 the amount of the balance to the Secretary of the 7 Interior for deposit in the account provided for in 8 section 8906(b)(3) of that title. 9 (2) ON EXPIRATION OF AUTHORITY.—If, on ex- 10 piration of the authority for the commemorative 11 work under section 8903(e) of title 40, United 12 States Code, there remains a balance of funds re- 13 ceived for the establishment of the commemorative 14 work under this section, the National Medal of 15 Honor Museum Foundation shall transmit the 16 amount of the balance to a separate account with 17 the National Park Foundation for memorials, to be 18 available to the Secretary of the Interior or the Ad- 19 ministrator of General Services, as appropriate, in 20 accordance with the process provided in paragraph 21 (4) of section 8906(b) of that title for accounts es- 22 tablished under paragraph (2) or (3) of that section. 23 VerDate Sep 11 2014 01:45 Dec 17, 2021 Jkt 029200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6201 E:\BILLS\S172.RS S172 pbinns on DSKJLVW7X2PROD with BILLS Calendar No. 199 117TH CONGRESS 1ST SESSION S. 172 [Report No. 117–49] A BILL To authorize the National Medal of Honor Museum Foundation to establish a commemorative work in the District of Columbia and its environs, and for other purposes.
