AN ACT
To amend the Public Health Service Act to provide best
practices on student suicide awareness and prevention
training and condition State educational agencies, local
educational agencies, and tribal educational agencies re-
ceiving funds under section 520A of such Act to establish
and implement a school-based student suicide awareness
and prevention training policy.
Be it enacted by the Senate and House of Representa-

SECTION 1. SHORT TITLE.
1
This Act may be cited as the ‘‘Suicide Training and
2
Awareness Nationally Delivered for Universal Prevention
3
Act of 2021’’ or the ‘‘STANDUP Act of 2021’’.
4
SEC. 2. STUDENT SUICIDE AWARENESS AND PREVENTION
5
TRAINING.
6
(a) IN GENERAL.—Title V of the Public Health Serv-
7
ice Act is amended by inserting after section 520A of such
8
Act (42 U.S.C. 290bb–32) the following:
9
‘‘SEC. 520B. STUDENT SUICIDE AWARENESS AND PREVEN-
10
TION TRAINING POLICIES.
11
‘‘(a) IN GENERAL.—As a condition on receipt of
12
funds under section 520A, each State educational agency,
13
local educational agency, and Tribal educational agency
14
that receives such funds, directly or through a State or
15
Indian Tribe, for activities to be performed within sec-
16
ondary schools, including the Project AWARE State Edu-
17
cation Agency Grant Program, shall—
18
‘‘(1) establish and implement a school-based
19
student suicide awareness and prevention training
20
policy;
21
‘‘(2) consult with stakeholders (including prin-
22
cipals, teachers, parents, local Tribal officials, and
23
other school leaders) in the development of the pol-
24
icy under subsection (a)(1); and

‘‘(3) collect and report information in accord-
1
ance with subsection (c).

‘‘(b) SCHOOL-BASED STUDENT SUICIDE AWARENESS
3
AND PREVENTION TRAINING POLICY.—A school-based
4
student suicide awareness and prevention training policy
5
implemented pursuant to subsection (a)—
6
‘‘(1) shall be evidence-based;
7
‘‘(2) shall be culturally and linguistically appro-
8
priate;
9
‘‘(3) shall provide evidence-based training to
10
students in grades 6 through 12, in coordination
11
with school-based mental health service providers as
12
defined in section 4102(6) of the Elementary and
13
Secondary Education Act of 1965, if applicable, re-
14
garding—
15
‘‘(A) suicide education and awareness, in-
16
cluding warning signs of self-harm or suicidal
17
ideation;
18
‘‘(B) methods that students can use to
19
seek help for themselves and others; and
20
‘‘(C) student resources for suicide aware-
21
ness and prevention;
22
‘‘(4) shall provide for retraining of such stu-
23
dents every school year;

‘‘(5) may last for such period as the State edu-
1
cational agency, local educational agency, or Tribal
2
educational agency involved determines to be appro-
3
priate;
4
‘‘(6) may be implemented through any delivery
5
method,
including
in-person
trainings,
digital
6
trainings, or train-the-trainer models; and
7
‘‘(7) may include discussion of comorbidities or
8
risk factors for suicidal ideation or self-harm, includ-
9
ing substance misuse, sexual or physical abuse, men-
10
tal illness, or other evidence-based comorbidities and
11
risk factors.

‘‘(c) COLLECTION OF INFORMATION AND REPORT-
13
ING.—Each State educational agency, local educational
14
agency, and Tribal educational agency that receives funds
15
under section 520A shall, with respect to each school
16
served by the agency, collect and report to the Secretary
17
the following information:
18
‘‘(1) The number of student trainings con-
19
ducted.
20
‘‘(2) The number of students trained, disaggre-
21
gated by age and grade level.
22
‘‘(3) The number of help-seeking reports made
23
by students after implementation of such policy.

‘‘(d) EVIDENCE-BASED
PROGRAM
LISTING.—The
1
Secretary of Health and Human Services shall coordinate
2
with the Secretary of Education to make publicly available
3
the policies established by State educational agencies, local
4
educational agencies, and Tribal educational agencies pur-
5
suant to this section and the training that is available to
6
students and teams pursuant to such policies, including
7
identification of whether such training is available to
8
trainees at no cost.
9
‘‘(e) IMPLEMENTATION TIMELINE.—A State edu-
10
cational agency, local educational agency, or Tribal edu-
11
cational agency shall establish and begin implementation
12
of the policies required by subsection (a)(1) not later than
13
the beginning of the third fiscal year following the date
14
of enactment of this section for which the agency receives
15
funds under section 520A.
16
‘‘(f) DEFINITIONS.—In this section and section
17
520B–1:
18
‘‘(1) The term ‘evidence-based’ has the meaning
19
given to such term in section 8101 of the Elemen-
20
tary and Secondary Education Act of 1965.
21
‘‘(2) The term ‘local educational agency’ has
22
the meaning given to such term in section 8101 of
23
the Elementary and Secondary Education Act of
24
1965.

‘‘(3) The term ‘State educational agency’ has

the meaning given to such term in section 8101 of
2
the Elementary and Secondary Education Act of
3
1965.

‘‘(4) The term ‘Tribal educational agency’ has
5
the meaning given to the term ‘tribal educational
6
agency’ in section 6132 of the Elementary and Sec-
7
ondary Education Act of 1965.

‘‘SEC. 520B–1. BEST PRACTICES FOR STUDENT SUICIDE
9
AWARENESS AND PREVENTION TRAINING.
10
‘‘The Secretary of Health and Human Services, in
11
consultation with the Secretary of Education and the Bu-
12
reau of Indian Education, shall—
13
‘‘(1) publish best practices for school-based stu-
14
dent suicide awareness and prevention training, pur-
15
suant to section 520B, that are based on—
16
‘‘(A) evidence-based practices; and
17
‘‘(B) input from relevant Federal agencies,
18
national organizations, Indian Tribes and Trib-
19
al organizations, and related stakeholders;
20
‘‘(2) publish guidance, based on the best prac-
21
tices under paragraph (1), to provide State edu-
22
cational agencies, local educational agencies, and
23
Tribal educational agencies with information on stu-

‘‘(3) disseminate such best practices to State
3
educational agencies, local educational agencies, and
4
Tribal educational agencies; and
5
‘‘(4) provide technical assistance to State edu-
6
cational agencies, local educational agencies, and
7
Tribal educational agencies.’’.

SEC. 3. EFFECTIVE DATE.
9
The amendments made by this Act shall only apply
10
with respect to applications for assistance under section
11
520A of the Public Health Service Act (42 U.S.C. 290bb–
12
32) that are submitted after the date of enactment of this
13
Act.
