A BILL
To provide for a moratorium on Federal funding to Planned
Parenthood Federation of America, Inc.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,
2
SECTION 1. SHORT TITLE.
3
This Act may be cited as the ‘‘Defund Planned Par-
4
enthood Act of 2021’’.
5
SEC. 2. FINDINGS.
6
Congress finds the following:
7
(1) State and county health departments, com-
8
munity health centers, hospitals, physicians offices,
9
and other entities currently provide, and will con-
10
tinue to provide, health services to women. Such
11
health services include relevant diagnostic laboratory
12
and radiology services, well-child care, prenatal and
13
postpartum care, immunization, family planning
14
services (including contraception), cervical and
15
breast cancer screenings and referrals, and sexually
16
transmitted disease testing.
17
(2) Many such entities provide services to all
18
persons, regardless of the person’s ability to pay,
19
and provide services in medically underserved areas
20
and to medically underserved populations.

(3) All funds that are no longer available to

Planned Parenthood Federation of America, Inc.
2
and its affiliates and clinics pursuant to this Act will
3
continue to be made available to other eligible enti-
4
ties to provide women’s health care services.
5
(4) Funds authorized to be appropriated, and
6
appropriated, by section 4 are offset by the funding
7
limitation under section 3(a).

SEC. 3. MORATORIUM ON FEDERAL FUNDING TO PLANNED
9
PARENTHOOD
FEDERATION
OF
AMERICA,
10
INC.
11
(a) IN GENERAL.—For the one-year period beginning
12
on the date of the enactment of this Act, subject to sub-
13
section (b), no funds authorized or appropriated by Fed-
14
eral law may be made available for any purpose to Planned
15
Parenthood Federation of America, Inc., or any affiliate
16
or clinic of Planned Parenthood Federation of America,
17
Inc., unless such entities certify that Planned Parenthood
18
Federation of America affiliates and clinics will not per-
19
form, and will not provide any funds to any other entity
20
that performs, an abortion during such period.
21
(b) EXCEPTION.—Subsection (a) shall not apply to
22
an abortion—
23
(1) if the pregnancy is the result of an act of
24
rape or incest; or

(2) in the case where a woman suffers from a
1
physical disorder, physical injury, or physical illness
2
that would, as certified by a physician, place the
3
woman in danger of death unless an abortion is per-
4
formed, including a life-endangering physical condi-
5
tion caused by or arising from the pregnancy itself.
6
(c) REPAYMENT.—The Secretary of Health and
7
Human Services and the Secretary of Agriculture shall
8
seek repayment of any Federal assistance received by
9
Planned Parenthood Federation of America, Inc., or any
10
affiliate or clinic of Planned Parenthood Federation of
11
America, Inc., if it violates the terms of the certification
12
required by subsection (a) during the period specified in
13
subsection (a).

SEC. 4. FUNDING FOR COMMUNITY HEALTH CENTER PRO-
15
GRAM.
16
(a) IN GENERAL.—There is authorized to be appro-
17
priated, and appropriated, $235,000,000 for the commu-
18
nity health center program under section 330 of the Public
19
Health Service Act (42 U.S.C. 254b), in addition to any
20
other funds made available to such program, for the period
21
for which the funding limitation under section 3(a) ap-
22
plies.

(b) LIMITATION.—None of the funds authorized or
1
appropriated pursuant to subsection (a) may be expended
2
for an abortion other than as described in section 3(b).

SEC. 5. RULE OF CONSTRUCTION.
4
Nothing in this Act shall be construed to reduce over-
5
all Federal funding available in support of women’s health.
