Be it enacted by the Senate and House of Representa- 1 tives of the United States of America in Congress assembled, 2 SECTION 1. SHORT TITLE. 3 This Act may be cited as the ‘‘Voter Registration Re- 4 porting Act of 2021’’. 5 SEC. 2. ANNUAL REPORTS ON VOTER REGISTRATION STA- 6 TISTICS. 7 (a) ANNUAL REPORT.—Not later than 90 days after 8 the end of each year, each State shall submit to the Elec- 9 tion Assistance Commission and Congress a report con- 10 VerDate Sep 11 2014 03:32 Mar 02, 2021 Jkt 019200 PO 00000 Frm 00001 Fmt 6652 Sfmt 6201 E:\BILLS\H639.IH H639 pbinns on DSKJLVW7X2PROD with BILLS 2 •HR 639 IH taining the following categories of information for the 1 year: 2 (1) The number of individuals who were reg- 3 istered by automatic registration. 4 (2) The number of voter registration applica- 5 tion forms completed by individuals that were trans- 6 mitted by motor vehicle authorities in the State 7 (pursuant to section 5(d) of the National Voter Reg- 8 istration Act of 1993) and voter registration agen- 9 cies in the State (as designated under section 7 of 10 such Act) to the chief State election official of the 11 State, broken down by each such authority and 12 agency. 13 (3) The number of such individuals whose voter 14 registration application forms were accepted and 15 who were registered to vote in the State and the 16 number of such individuals whose forms were re- 17 jected and who were not registered to vote in the 18 State, broken down by each such authority and 19 agency. 20 (4) The number of change of address forms and 21 other forms of information indicating that an indi- 22 vidual’s identifying information has been changed 23 that were transmitted by such motor vehicle authori- 24 ties and voter registration agencies to the chief State 25 VerDate Sep 11 2014 03:32 Mar 02, 2021 Jkt 019200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\H639.IH H639 pbinns on DSKJLVW7X2PROD with BILLS 3 •HR 639 IH election official of the State, broken down by each 1 such authority and agency and the type of form 2 transmitted. 3 (5) The number of individuals on the statewide 4 computerized voter registration list (as established 5 and maintained under section 303 of the Help 6 America Vote Act of 2002) whose voter registration 7 information was revised by the chief State election 8 official as a result of the forms transmitted to the 9 official by such motor vehicle authorities and voter 10 registration agencies (as described in paragraph 11 (3)), broken down by each such authority and agen- 12 cy and the type of form transmitted. 13 (6) The number of individuals who requested 14 the chief State election official to revise voter reg- 15 istration information on such list, and the number of 16 individuals whose information was revised as a result 17 of such a request. 18 (b) BREAKDOWN OF INFORMATION.—In preparing 19 the report under this section, the State shall, for each cat- 20 egory of information described in subsection (a), include 21 a breakdown by race, ethnicity, age, and gender of the 22 individuals whose information is included in the category, 23 to the extent that information on the race, ethnicity, age, 24 and gender of such individuals is available to the State. 25 VerDate Sep 11 2014 03:32 Mar 02, 2021 Jkt 019200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6201 E:\BILLS\H639.IH H639 pbinns on DSKJLVW7X2PROD with BILLS 4 •HR 639 IH (c) CONFIDENTIALITY OF INFORMATION.—In pre- 1 paring and submitting a report under this section, the 2 chief State election official shall ensure that no informa- 3 tion regarding the identification of any individual is re- 4 vealed. 5 (d) DEFINITIONS.— 6 (1) AUTOMATIC VOTER REGISTRATION.—In this 7 section, the term ‘‘automatic registration’’ means a 8 system that registers an individual to vote in elec- 9 tions for Federal office in a State, if eligible, by elec- 10 tronically transferring the information necessary for 11 registration from government agencies to election of- 12 ficials of the State so that, unless the individual af- 13 firmatively declines to be registered, the individual 14 will be registered to vote in such elections. 15 (2) STATE.—In this section, the term ‘‘State’’ 16 includes the District of Columbia, the Common- 17 wealth of Puerto Rico, the United States Virgin Is- 18 lands, Guam, American Samoa, and the Common- 19 wealth of the Northern Mariana Islands, but does 20 not include any State in which, under a State law 21 in effect continuously on and after the date of the 22 enactment of this Act, there is no voter registration 23 VerDate Sep 11 2014 03:32 Mar 02, 2021 Jkt 019200 PO 00000 Frm 00004 Fmt 6652 Sfmt 6201 E:\BILLS\H639.IH H639 pbinns on DSKJLVW7X2PROD with BILLS 5 •HR 639 IH requirement for individuals in the State with respect 1 to elections for Federal office. 2 Æ VerDate Sep 11 2014 03:32 Mar 02, 2021 Jkt 019200 PO 00000 Frm 00005 Fmt 6652 Sfmt 6301 E:\BILLS\H639.IH H639 pbinns on DSKJLVW7X2PROD with BILLS
