SHORT TITLE. 1 This Act may be cited as the ‘‘No Abortion Bonds 2 Act’’. 3 SEC. 2. INTEREST ON STATE AND LOCAL BONDS USED FOR 4 FACILITIES OWNED BY ABORTION PRO- 5 VIDERS. 6 (a) IN GENERAL.—Section 103 of the Internal Rev- 7 enue Code of 1986 is amended— 8 (1) in subsection (b), by adding at the end the 9 following new paragraph: 10 ‘‘(4) BONDS FOR FACILITIES OWNED BY ABOR- 11 TION PROVIDERS.—Any bond issued as part of an 12 issue any of the net proceeds of which are to be used 13 to provide a facility owned by an abortion provider 14 or used (for any purpose) by an abortion provider 15 for more than 30 days during any calendar year 16 during which interest is paid on such bond.’’; and 17 (2) in subsection (c), by adding at the end the 18 following new paragraph: 19 ‘‘(3) ABORTION PROVIDER.— 20 ‘‘(A) IN GENERAL.—For purposes of this 21 section, the term ‘abortion provider’ means, 22 with respect to an issue of bonds— 23 ‘‘(i) an entity that, as of the date of 24 such issue, performs abortions, and 25 VerDate Sep 11 2014 03:49 Feb 20, 2021 Jkt 019200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\H606.IH H606 kjohnson on DSK79L0C42PROD with BILLS 3 •HR 606 IH ‘‘(ii) an entity if any affiliate of such 1 entity is an entity described in clause (i). 2 ‘‘(B) EXEMPTION.—For purposes of this 3 paragraph, an entity shall not be considered an 4 abortion provider solely as a result of per- 5 forming abortions— 6 ‘‘(i) if the pregnancy is the result of 7 an act of rape or incest, or 8 ‘‘(ii) in the case where a woman suf- 9 fers from a physical disorder, physical in- 10 jury, or physical illness that would, as cer- 11 tified by a physician, place the woman in 12 danger of death unless an abortion is per- 13 formed, including a life-endangering phys- 14 ical condition caused by or arising from 15 the pregnancy itself. 16 ‘‘(C) EXEMPTION FOR HOSPITALS.—The 17 Secretary may deem that the term ‘abortion 18 provider’ does not include a subsection (d) hos- 19 pital (as such term is defined in section 20 1886(d) of the Social Security Act) by making 21 the name of such hospital available on the pub- 22 lic internet website of the Treasury.’’. 23 VerDate Sep 11 2014 03:49 Feb 20, 2021 Jkt 019200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6201 E:\BILLS\H606.IH H606 kjohnson on DSK79L0C42PROD with BILLS 4 •HR 606 IH (b) EFFECTIVE DATE.—The amendment made by 1 this section shall apply with respect to bonds issued after 2 the date of enactment of this Act. 3 Æ VerDate Sep 11 2014 03:49 Feb 20, 2021 Jkt 019200 PO 00000 Frm 00004 Fmt 6652 Sfmt 6301 E:\BILLS\H606.IH H606 kjohnson on DSK79L0C42PROD with BILLS
