Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,
2
SECTION 1. SHORT TITLE.
3
This Act may be cited as the ‘‘Southeast Alaska Re-
4
gional Health Consortium Land Transfer Act’’.
5
SEC. 2. CONVEYANCE OF PROPERTY.
6
(a) IN GENERAL.—As soon as practicable, but not
7
later than 2 years, after the date of enactment of this Act,
8
the Secretary of Health and Human Services (referred to
9
in this Act as the ‘‘Secretary’’) shall convey to the South-
10
east Alaska Regional Health Consortium located in Sitka,
11
Alaska (referred to in this Act as the ‘‘Consortium’’), all
12
right, title, and interest of the United States in and to
13
the property described in section 3 for use in connection
14
with health and social services programs.

(b) CONDITIONS.—The conveyance of the property
16
under subsection (a)—
17
(1) shall be made by warranty deed; and
18
(2) shall not—
19
(A) require any consideration from the
20
Consortium for the property;
21
(B) impose any obligation, term, or condi-
22
tion on the Consortium; or
23
(C) allow for any reversionary interest of
24
the United States in the property.

(c) EFFECT ON ANY QUITCLAIM DEED.—The con-
1
veyance by the Secretary of title by warranty deed under
2
subsection (a) shall, on the effective date of the convey-
3
ance, supersede and render of no future effect any quit-
4
claim deed to the property described in section 3 executed
5
by the Secretary and the Consortium.

SEC. 3. PROPERTY DESCRIBED.
7
The property, including all land and appurtenances,
8
described in this section is the property included in U.S.
9
Survey 1496, lots 4 and 7, partially surveyed T. 55 S.,
10
R. 63 E., Copper River Meridian, containing approxi-
11
mately 10.87 acres in Sitka, Alaska.
12
SEC. 4. ENVIRONMENTAL LIABILITY.

(a) LIABILITY.—
14
(1) IN GENERAL.—Notwithstanding any other
15
provision of law, the Consortium shall not be liable
16
for any soil, surface water, groundwater, or other
17
contamination resulting from the disposal, release,
18
or presence of any environmental contamination on
19
any portion of the property described in section 3 on
20
or before the date on which the property is conveyed
21
to the Consortium, except that the Secretary shall
22
not be liable for any contamination that occurred
23
after the date that the Consortium controlled, occu-
24
pied, and used the property.

(2) ENVIRONMENTAL CONTAMINATION.—An en-
1
vironmental contamination described in paragraph
2
(1) includes any oil or petroleum products, haz-
3
ardous substances, hazardous materials, hazardous
4
waste, pollutants, toxic substances, solid waste, or
5
any other environmental contamination or hazard as
6
defined in any Federal or State of Alaska law.
7
(b) EASEMENT.—The Secretary shall be accorded
8
any easement or access to the property conveyed under
9
this Act as may be reasonably necessary to satisfy any
10
retained obligation or liability of the Secretary.
11
(c) NOTICE OF HAZARDOUS SUBSTANCE ACTIVITY
12
AND WARRANTY.—In carrying out this Act, the Secretary
13
shall comply with subparagraphs (A) and (B) of section
14
120(h)(3) of the Comprehensive Environmental Response,
15
Compensation, and Liability Act of 1980 (42 U.S.C.
16
9620(h)(3)).
