SHORT TITLE. 3 This Act may be cited as the ‘‘Alaska Native Tribal 4 Health Consortium Land Transfer Act’’. 5 SEC. 2. CONVEYANCE OF PROPERTY TO THE ALASKA NA- 6 TIVE TRIBAL HEALTH CONSORTIUM. 7 (a) CONVEYANCE OF PROPERTY.— 8 (1) IN GENERAL.—As soon as practicable, but 9 not later than 1 year, after the date of enactment 10 of this Act, the Secretary of Health and Human 11 Services (referred to in this Act as the ‘‘Secretary’’) 12 shall convey to the Alaska Native Tribal Health 13 Consortium located in Anchorage, Alaska (referred 14 to in this section as the ‘‘Consortium’’), all right, 15 title, and interest of the United States in and to the 16 property described in subsection (b) for use in con- 17 nection with health programs. 18 (2) CONDITIONS.—The conveyance of the prop- 19 erty under paragraph (1)— 20 (A) shall be made by warranty deed; and 21 (B) shall not— 22 (i) require any consideration from the 23 Consortium for the property; 24 VerDate Sep 11 2014 21:05 Dec 30, 2022 Jkt 039200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6201 E:\BILLS\H443.RH H443 pamtmann on DSKBC07HB2PROD with BILLS 4 •HR 443 RH (ii) impose any obligation, term, or 1 condition on the Consortium; or 2 (iii) allow for any reversionary interest 3 of the United States in the property. 4 (3) EFFECT ON ANY QUITCLAIM DEED.—The 5 conveyance by the Secretary of title by warranty 6 deed under paragraph (1) shall, on the effective date 7 of the conveyance, supersede and render of no future 8 effect any quitclaim deed to the property described 9 in subsection (b) executed by the Secretary and the 10 Consortium. 11 (b) PROPERTY DESCRIBED.—The property referred 12 to in subsection (a), including all land, improvements, and 13 appurtenances, is— 14 (1) Lot 1A in Block 31A, East Addition, An- 15 chorage Townsite, United States Survey No. 408, 16 Plat No. 96–117, recorded on November 22, 1996, 17 in the Anchorage Recording District; and 18 (2) Block 32C, East Addition, Anchorage 19 Townsite, United States Survey No. 408, Plat No. 20 96–118, recorded on November 22, 1996, in the An- 21 chorage Recording District. 22 (c) ENVIRONMENTAL LIABILITY.— 23 (1) LIABILITY.— 24 VerDate Sep 11 2014 21:05 Dec 30, 2022 Jkt 039200 PO 00000 Frm 00004 Fmt 6652 Sfmt 6201 E:\BILLS\H443.RH H443 pamtmann on DSKBC07HB2PROD with BILLS 5 •HR 443 RH (A) IN GENERAL.—Notwithstanding any 1 other provision of law, the Consortium shall not 2 be liable for any soil, surface water, ground- 3 water, or other contamination resulting from 4 the disposal, release, or presence of any envi- 5 ronmental contamination on any portion of the 6 property described in subsection (b) that oc- 7 curred on or before the date on which the Con- 8 sortium controlled, occupied, and used the prop- 9 erty. 10 (B) ENVIRONMENTAL CONTAMINATION.— 11 An environmental contamination described in 12 subparagraph (A) includes any oil or petroleum 13 products, hazardous substances, hazardous ma- 14 terials, hazardous waste, pollutants, toxic sub- 15 stances, solid waste, or any other environmental 16 contamination or hazard as defined in any Fed- 17 eral or State of Alaska law. 18 (2) EASEMENT.—The Secretary shall be ac- 19 corded any easement or access to the property con- 20 veyed under subsection (a)(1) as may be reasonably 21 necessary to satisfy any retained obligation or liabil- 22 ity of the Secretary. 23 (3) NOTICE OF HAZARDOUS SUBSTANCE ACTIV- 24 ITY AND WARRANTY.—In carrying out this section, 25 VerDate Sep 11 2014 21:05 Dec 30, 2022 Jkt 039200 PO 00000 Frm 00005 Fmt 6652 Sfmt 6201 E:\BILLS\H443.RH H443 pamtmann on DSKBC07HB2PROD with BILLS 6 •HR 443 RH the Secretary shall comply with subparagraphs (A) 1 and (B) of section 120(h)(3) of the Comprehensive 2 Environmental Response, Compensation, and Liabil- 3 ity Act of 1980 (42 U.S.C. 9620(h)(3)). 4 VerDate Sep 11 2014 21:05 Dec 30, 2022 Jkt 039200 PO 00000 Frm 00006 Fmt 6652 Sfmt 6201 E:\BILLS\H443.RH H443 pamtmann on DSKBC07HB2PROD with BILLS VerDate Sep 11 2014 21:05 Dec 30, 2022 Jkt 039200 PO 00000 Frm 00007 Fmt 6652 Sfmt 6201 E:\BILLS\H443.RH H443 pamtmann on DSKBC07HB2PROD with BILLS Union Calendar No. 490 117TH CONGRESS 2D SESSION H.
