SHORT TITLE. 1 This Act may be cited as the ‘‘COVID–19 Home 2 Safety Act of 2021’’. 3 SEC. 2. REPORT. 4 (a) COVID–19 REPORT REQUIRED.—Not later than 5 3 months after the date of the enactment of this section 6 and every 3 months thereafter for the duration of the 7 COVID–19 public health emergency, the Consumer Prod- 8 uct Safety Commission shall submit to the Committee on 9 Energy and Commerce of the House of Representatives 10 and the Committee on Commerce, Science, and Transpor- 11 tation of the Senate, and make publicly available, a report 12 on the effect of the COVID–19 public health emergency 13 on injuries and deaths from consumer products. 14 (b) CONTENTS OF REPORT.—The report shall include 15 the following: 16 (1) A list of the top consumer products, 17 prioritizing products that caused serious injury or 18 death as well as products that have been associated 19 with the highest risk of serious injury or death dur- 20 ing the COVID–19 emergency. The list under this 21 paragraph should be based on relevant data and sta- 22 tistics from— 23 (A) the data sources of the Commission; 24 (B) other appropriate agencies; 25 (C) media reports; 26 VerDate Sep 11 2014 01:25 Dec 19, 2021 Jkt 029200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\S116.RS S116 pbinns on DSKJLVW7X2PROD with BILLS 3 •S 116 RS (D) poison control centers, to the extent 1 practical; and 2 (E) any other relevant data sources. 3 (2) An identification of trends in injuries and 4 deaths in the consumer products listed under para- 5 graph (1), comparing data from representative time 6 periods before and during the COVID–19 public 7 health emergency. 8 (3) An identification of subpopulations that 9 have experienced elevated risk of injury or death 10 from the consumer products listed under paragraph 11 (1) during the COVID–19 public health emergency, 12 such as minorities, infants, people with disabilities, 13 children, or the elderly. 14 (4) An identification of where most injuries or 15 deaths from consumer products during the COVID– 16 19 public health emergency are taking place, such as 17 the type of building or outdoor environment. 18 (5) An identification of whether any specific 19 consumer products in the categories described in 20 paragraph (1) are— 21 (A) under recall or other corrective action; 22 (B) subject to a voluntary consumer prod- 23 uct safety standard; or 24 VerDate Sep 11 2014 01:25 Dec 19, 2021 Jkt 029200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6201 E:\BILLS\S116.RS S116 pbinns on DSKJLVW7X2PROD with BILLS 4 •S 116 RS (C) subject to a mandatory consumer prod- 1 uct safety standard. 2 (6) An identification of any emerging consumer 3 products or consumer product categories that are 4 posing new risks to consumers. 5 (7) A comprehensive assessment of the Com- 6 mission’s operations, re-entry criteria and associated 7 metrics, operational readiness, enforcement efforts 8 (including import-export surveillance of counterfeit 9 and untested consumer goods and laboratory func- 10 tions), and corrective action taken (including the 11 number of corrective actions announced and recall 12 effectiveness) during the COVID–19 public health 13 emergency and recommendations to improve the 14 Commission’s ability to address unforeseen effects of 15 the COVID–19 public health emergency with regard 16 to consumer product safety. 17 (c) DISTRIBUTION OF INFORMATION.—The Con- 18 sumer Product Safety Commission shall coordinate with 19 public media outlets to distribute resource information 20 based on the report under this section to help increase 21 home safety during the COVID–19 public health emer- 22 gency, including information such as Home Safe Check- 23 lists. 24 VerDate Sep 11 2014 01:25 Dec 19, 2021 Jkt 029200 PO 00000 Frm 00004 Fmt 6652 Sfmt 6201 E:\BILLS\S116.RS S116 pbinns on DSKJLVW7X2PROD with BILLS 5 •S 116 RS (d) COVID–19 PUBLIC HEALTH EMERGENCY DE- 1 FINED.—The term ‘‘COVID–19 public health emergency’’ 2 means a public health emergency declared pursuant to sec- 3 tion 319 of the Public Health Service Act (42 U.S.C. 4 247d) as a result of confirmed cases of 2019 novel 5 coronavirus (COVID–19), including any renewal thereof. 6 VerDate Sep 11 2014 01:25 Dec 19, 2021 Jkt 029200 PO 00000 Frm 00005 Fmt 6652 Sfmt 6201 E:\BILLS\S116.RS S116 pbinns on DSKJLVW7X2PROD with BILLS Calendar No. 205 117TH CONGRESS 1ST SESSION S. 116 A BILL To require the Consumer Product Safety Commis- sion to study the effect of the COVID–19 pan- demic on injuries and deaths associated with con- sumer products, and for other purposes.
