SHORT TITLE. 1 This Act may be cited as the ‘‘Transit Security Grant 2 Program Flexibility Act’’. 3 SEC. 2. ALLOWABLE USES OF FUNDS FOR PUBLIC TRANS- 4 PORTATION SECURITY ASSISTANCE GRANTS. 5 Subparagraph (A) of section 1406(b)(2) of the Imple- 6 menting Recommendations of the 9/11 Commission Act of 7 2007 (6 U.S.C. 1135(b)(2); Public Law 110–53) is 8 amended by inserting ‘‘and associated backfill’’ after ‘‘se- 9 curity training’’. 10 SEC. 3. PERIODS OF PERFORMANCE FOR PUBLIC TRANS- 11 PORTATION SECURITY ASSISTANCE GRANTS. 12 Section 1406 of the Implementing Recommendations 13 of the 9/11 Commission Act of 2007 (6 U.S.C. 1135; Pub- 14 lic Law 110–53) is amended— 15 (1) by redesignating subsection (m) as sub- 16 section (n); and 17 (2) by inserting after subsection (l) the fol- 18 lowing new subsection: 19 ‘‘(m) PERIODS OF PERFORMANCE.— 20 ‘‘(1) IN GENERAL.—Except as provided in para- 21 graph (2), funds provided pursuant to a grant 22 awarded under this section for a use specified in 23 subsection (b) shall remain available for use by a 24 grant recipient for a period of not fewer than 36 25 months. 26 VerDate Sep 11 2014 17:52 Apr 23, 2021 Jkt 019200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\H396.RFS H396 pamtmann on DSKBC07HB2PROD with BILLS 3 HR 396 RFS ‘‘(2) EXCEPTION.—Funds provided pursuant to 1 a grant awarded under this section for a use speci- 2 fied in subparagraph (M) or (N) of subsection (b)(1) 3 shall remain available for use by a grant recipient 4 for a period of not fewer than 55 months.’’. 5 SEC. 4. GAO REVIEW. 6 (a) IN GENERAL.—The Comptroller General of the 7 United States shall conduct a review of the public trans- 8 portation security assistance grant program under section 9 1406 of the Implementing Recommendations of the 9/11 10 Commission Act of 2007 (6 U.S.C. 1135; Public Law 11 110–53). 12 (b) SCOPE.—The review required under paragraph 13 (1) shall include the following: 14 (1) An assessment of the type of projects fund- 15 ed under the public transportation security grant 16 program referred to in such paragraph. 17 (2) An assessment of the manner in which such 18 projects address threats to public transportation in- 19 frastructure. 20 (3) An assessment of the impact, if any, of this 21 Act (including the amendments made by this Act) on 22 types of projects funded under the public transpor- 23 tation security assistance grant program. 24 VerDate Sep 11 2014 17:52 Apr 23, 2021 Jkt 019200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6201 E:\BILLS\H396.RFS H396 pamtmann on DSKBC07HB2PROD with BILLS 4 HR 396 RFS (4) An assessment of the management and ad- 1 ministration of public transportation security assist- 2 ance grant program funds by grantees. 3 (5) Recommendations to improve the manner in 4 which public transportation security assistance grant 5 program funds address vulnerabilities in public 6 transportation infrastructure. 7 (6) Recommendations to improve the manage- 8 ment and administration of the public transportation 9 security assistance grant program. 10 (c) REPORT.—Not later than one year after the date 11 of the enactment of this Act and again not later than five 12 years after such date of enactment, the Comptroller Gen- 13 eral of the United States shall submit to the Committee 14 on Homeland Security of the House of Representatives 15 and the Committee on Homeland Security and Govern- 16 mental Affairs of the Senate a report on the review re- 17 quired under this section. 18 SEC. 5.
