No Asylum for Criminals Act of 2021

Be it enacted by the Senate and House of Representa- 1 tives of the United States of America in Congress assembled, 2 SECTION 1. ALIENS CONVICTED OF CRIMES INELIGIBLE FOR 1 ASYLUM. 2 Clause (ii) of section 208(b)(2) of the Immigration 3 and Nationality Act (8 U.S.C. 1158) is amended— 4 (1) by amending clause (ii) of subparagraph (A) 5 to read as follows: 6 ‘‘(ii) except as provided in subpara- 7 graph (B), the alien has been finally con- 8 victed of a crime;’’; and 9 (2) by amending subparagraph (B) to read as 10 follows: 11 ‘‘(B) EXCEPTION.—The Secretary of 12 Homeland Security may designate by regulation 13 political offenses committed outside the United 14 States that will be not considered to be a crime 15 described in clause (ii).
