Further, section 5 3 of the 14th Amendment to the Constitution prohibits 6 any person who has ‘‘engaged in insurrection or rebellion 7 against’’ the United States from ‘‘hold[ing] any office . . . 8 under the United States’’. In his conduct while President 9 of the United States—and in violation of his constitutional 10 oath faithfully to execute the office of President of the 11 United States and, to the best of his ability, preserve, pro- 12 tect, and defend the Constitution of the United States, 13 and in violation of his constitutional duty to take care that 14 the laws be faithfully executed—Donald John Trump en- 15 gaged in high Crimes and Misdemeanors by inciting vio- 16 lence against the Government of the United States, in 17 that: 18 On January 6, 2021, pursuant to the 12th Amend- 19 ment to the Constitution of the United States, the Vice 20 President of the United States, the House of Representa- 21 tives, and the Senate met at the United States Capitol 22 for a Joint Session of Congress to count the votes of the 23 Electoral College. Shortly before the Joint Session commenced, 4 President Trump, addressed a crowd at the Ellipse in 5 Washington, DC. There, he reiterated false claims that 6 ‘‘we won this election, and we won it by a landslide’’. He 7 also willfully made statements that, in context, encour- 8 aged—and foreseeably resulted in—lawless action at the 9 Capitol, such as: ‘‘if you don’t fight like hell you’re not 10 going to have a country anymore’’. Thus incited by Presi- 11 dent Trump, members of the crowd he had addressed, in 12 an attempt to, among other objectives, interfere with the 13 Joint Session’s solemn constitutional duty to certify the 14 results of the 2020 Presidential election, unlawfully 15 breached and vandalized the Capitol, injured and killed 16 law enforcement personnel, menaced Members of Con- 17 gress, the Vice President, and Congressional personnel, 18 and engaged in other violent, deadly, destructive, and sedi- 19 tious acts. 20 President Trump’s conduct on January 6, 2021, fol- 21 lowed his prior efforts to subvert and obstruct the certifi- 22 cation of the results of the 2020 Presidential election. 23 Those prior efforts included a phone call on January 2, 24 2021, during which President Trump urged the secretary 25 VerDate Sep 11 2014 03:50 Apr 27, 2021 Jkt 019200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6201 E:\BILLS\HR24.RDS HR24 pbinns on DSKJLVW7X2PROD with BILLS 4 HRES 24 RDS of state of Georgia, Brad Raffensperger, to ‘‘find’’ enough 1 votes to overturn the Georgia Presidential election results 2 and threatened Secretary Raffensperger if he failed to do 3 so. 4 In all this, President Trump gravely endangered the 5 security of the United States and its institutions of Gov- 6 ernment. He threatened the integrity of the democratic 7 system, interfered with the peaceful transition of power, 8 and imperiled a coequal branch of Government. He there- 9 by betrayed his trust as President, to the manifest injury 10 of the people of the United States. 11 Wherefore, Donald John Trump, by such conduct, 12 has demonstrated that he will remain a threat to national 13 security, democracy, and the Constitution if allowed to re- 14 main in office, and has acted in a manner grossly incom- 15 patible with self-governance and the rule of law.
