Be it enacted by the Senate and House of Representa- 1 tives of the United States of America in Congress assembled, 2 SECTION 1. ELIMINATION OF GENERAL MEDICAID FUNDING 1 LIMITATIONS (‘‘CAP’’) FOR TERRITORIES. 2 (a) IN GENERAL.—Section 1108 of the Social Secu- 3 rity Act (42 U.S.C. 1308) is amended— 4 (1) in subsection (f), in the matter preceding 5 paragraph (1), by striking ‘‘subsection (g)’’ and in- 6 serting ‘‘subsections (g) and (h)’’; 7 (2) in subsection (g)(2), in the matter pre- 8 ceding subparagraph (A), by striking ‘‘and para- 9 graphs (3) and (5)’’ and inserting ‘‘, paragraphs (3) 10 and (5), and subsection (h)’’; and 11 (3) by adding at the end the following new sub- 12 section: 13 ‘‘(h) SUNSET OF MEDICAID FUNDING LIMITA- 14 TIONS.—Subsections (f) and (g) shall not apply to Puerto 15 Rico, the Virgin Islands, Guam, the Northern Mariana Is- 16 lands, and American Samoa beginning with fiscal year 17 2021.’’. 18 (b) CONFORMING AMENDMENTS.— 19 (1) Section 1902(j) of the Social Security Act 20 (42 U.S.C. 1396a(j)) is amended by striking ‘‘, the 21 limitation in section 1108(f),’’. 22 (2) Section 1903(u) of the Social Security Act 23 (42 U.S.C. 1396b(u)) is amended by striking para- 24 graph (4). 25 VerDate Sep 11 2014 05:44 Feb 05, 2021 Jkt 019200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\H265.IH H265 kjohnson on DSK79L0C42PROD with BILLS 3 •HR 265 IH (c) EFFECTIVE DATE.—The amendments made by 1 this section shall apply beginning with fiscal year 2021. 2 Æ VerDate Sep 11 2014 05:44 Feb 05, 2021 Jkt 019200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6301 E:\BILLS\H265.IH H265 kjohnson on DSK79L0C42PROD with BILLS
