What This Bill Does
This bill allows the Secretary of State to refuse to issue passports to people who have aided, assisted or helped foreign terrorist organizations. It also allows the Secretary to take back passports that were already issued to such people. The bill requires the Secretary to report these actions to Congress within 30 days.

• The definition of "passport" includes a passport card. (Sec. 4(d))

The Passport Act of 1926 is amended to add new authority allowing the Secretary of State to deny or revoke passports based on an individual's affiliation with a foreign terrorist organization.

VIDUALS AFFILIATED WITH FOREIGN TER-

RORIST ORGANIZATIONS.

The Act entitled ‘‘An Act to regulate the issue and
4
validity of passports, and for other purposes’’, approved
5
July 3, 1926 (22 U.S.C. 211a et seq.), commonly known
6
as the ‘‘Passport Act of 1926’’, is amended by adding at
7
the end the following new section:

‘‘SEC. 4. AUTHORITY TO DENY OR REVOKE PASSPORT.
9
‘‘(a) INELIGIBILITY.—
10
‘‘(1) ISSUANCE.—Except as provided under
11
subsection (b), the Secretary of State may refuse to
12
issue a passport to any individual whom the Sec-
13
retary has determined has aided, assisted, abetted,
14
or otherwise helped an organization the Secretary
15
has designated as a foreign terrorist organization
16
pursuant to section 219 of the Immigration and Na-
17
tionality Act (8 U.S.C. 1189).

‘‘(2) REVOCATION.—The Secretary of State
19
may revoke a passport previously issued to any indi-
20
vidual described in paragraph (1).
21
‘‘(b) RIGHT OF REVIEW.—Any individual who, in ac-
22
cordance with this section, is denied issuance of a passport
23
by the Secretary of State, or whose passport is revoked
24
by the Secretary, may request a hearing before the Sec-

retary not later than 60 days after receiving notice of such

‘‘(c) REPORT.—
3
‘‘(1) IN GENERAL.—If the Secretary of State
4
refuses to issue or revokes a passport pursuant to
5
subsection (a), or if, subsequent to a hearing pursu-
6
ant to subsection (b), the Secretary issues or cancels
7
a revocation of a passport that was the subject of
8
such a hearing, the Secretary shall, not later than
9
30 days after such refusal or revocation, or such
10
issuance or cancellation, submit to the Committee on
11
Foreign Affairs of the House of Representatives and
12
the Committee on Foreign Relations of the Senate
13
a report on such refusal, revocation, issuance, or
14
cancellation, as the case may be.

‘‘(2) FORM.—The report submitted under para-
16
graph (1) may be submitted in classified or unclassi-
17
fied form.
18
‘‘(d) DEFINITION.—In this section, the term ‘pass-
19
port’ includes a passport card.’’.
